Ankara Metropolitan Municipality Mayor Mansur Yavaş, commenting on the 'absolute nullity' decision regarding the 38th Ordinary Congress of the CHP, said, "What needs to be done is not to escalate tensions, but to act with common sense, announce that the party will decide on holding a congress within 1-2 months on its own accord, and manage the process within democratic traditions."
Ankara Metropolitan Municipality Mayor Mansur Yavaş made an assessment on his social media account regarding the absolute nullity decision issued by the Ankara Regional Court of Justice 36th Civil Chamber about the CHP's 38th Ordinary Congress.
Yavaş stated that what is needed is not only the CHP's internal unity but also, 'It is the gathering of all opposition segments in Turkey that believe in democracy, law, and national will under common sense and common conscience.' Yavaş noted that what needs to be done is for the party to announce that it will make a congress decision within 1-2 months on its own volition.
“THERE IS A COURT DECISION, AND IN A STATE OF LAW, NO DECISION CAN BE IGNORED”
Yavaş used the following statements: 'The issuance of an absolute nullity decision regarding our Republican People's Party is one of the clearest indicators of how severely law, democracy, and national will are being suppressed in Turkey.
Moreover, one of the most striking and gravest points here is this… While criminal cases have not yet been concluded, the court effectively expressing an opinion that "election fraud was committed" means stepping into the role of the criminal court and rendering a verdict. However, in a state of law, no person or institution can replace an ongoing judicial process that has not been finalized.
Article 79 of the Constitution is clear. The management and supervision of elections are under the authority of the Supreme Election Council, and YSK decisions are final. The authority regarding the management of election processes and the congress will of political parties is clearly stated in our constitution. While the duties and authorities of provincial and district election boards are evident, these boundaries cannot be exceeded.
Of course, there is a court decision, and in a state of law, no decision can be ignored. However, legal processes cannot be turned into tools for weakening, dividing, or liquidating political parties.
“WHAT NEEDS TO BE DONE IS FOR THE PARTY TO ANNOUNCE THAT IT WILL MAKE A CONGRESS DECISION WITHIN 1-2 MONTHS ON ITS OWN VOLITION”
The aim is to draw the Republican People's Party into internal debates, damage the sense of unity, and neutralize Turkey's main opposition. Such a process has no benefit for Turkey. On the contrary, this situation deepens social polarization, weakens trust in politics, and only plays into the hands of the government.
Therefore, what needs to be done is not to escalate tensions but to act with common sense, announce that the party will make a congress decision within 1-2 months on its own volition, and manage the process within democratic norms.
Overcoming this process with unity and solidarity and with calmness is our greatest responsibility to the millions of people who have placed their hopes in us. None of us, including myself, can escape this responsibility.
In this process, it is especially necessary to avoid attitudes and rhetoric that would harm our unity and solidarity. Otherwise, those who made these decisions and those who want to escalate these debates will achieve their goals.
DRAWS ATTENTION TO THE "POSSIBILITY OF ELECTION"
Given Turkey's current economic and social situation, it should not be forgotten that the government is highly likely to bring up all kinds of political moves in the upcoming period, including a snap election.
What is needed today is not only the Republican People's Party's internal solidarity. It is the gathering of all opposition segments in Turkey that believe in democracy, law, and national will under common sense and common conscience.'
