The 12th Judicial Package, completed by the AK Party, will be submitted to the Turkish Grand National Assembly Presidency next week. According to the regulation in the package, sharing account information with others for unjust benefit will be defined as an independent crime and will be punishable by imprisonment. Those who share account information with others and those who use these accounts for fraud will be punished under the new crime instead of 'qualified fraud'.
According to information received by an AA reporter, AK Party deputies, under the chairmanship of Group Chair Abdullah Güler, have completed work on the draft law known publicly as the 12th Judicial Package.
12TH JUDICIAL PACKAGE COMES TO PARLIAMENT
With the draft law expected to be submitted to the Speaker's Office of the Turkish Grand National Assembly next week, regulations will be made regarding the targets and activities in the 4th Judicial Reform Strategy Document announced by President Erdoğan.
With the draft, to accelerate trials, ensure procedural economy, and more effectively realize the right to a trial within a reasonable time, according to the amendment to be made to the Code of Civil Procedure, the period between hearings in civil proceedings cannot exceed three months. In compulsory cases such as prolonged expert examination due to the nature of the matter or conducting investigations via letters rogatory, the judge may determine a longer period by stating the justification.
SCOPE OF E-HEARING SYSTEM EXPANDED
To benefit more from the advantages provided by information technologies in the judiciary, the scope of the e-Hearing system will be expanded, and preliminary examination hearings will also be conducted via e-Hearing.
NEW PENALTY COMES FOR THOSE SHARING BANK INFORMATION
With the amendment to the Turkish Penal Code, sharing account information with others for unjust benefit will be regulated as an independent crime and will be punishable by imprisonment. Due to the creation of the new offense, those who share account information with others and those who use these accounts in fraud will be punished under the new crime instead of "qualified fraud."
To conclude trials within a reasonable time, a regulation will be made so that, except for decisions made by regional courts of justice acting as courts of first instance, first instance courts cannot be overturned by the Court of Cassation solely on the grounds of lack of jurisdiction or authority.
In line with the annulment decisions of the Constitutional Court, amendments will be made to certain laws to fill legal gaps.
