Babacan said, "Who will govern political parties is determined not by court decisions, but by the will of members, delegates, and voters. STRIKING WORDS FROM BABACAN

While the recent debates and judicial decisions in the opposition front have become the main agenda of politics, Babacan stated that the judiciary cannot be turned into a tool to shape politics in this process.

"WHO WILL LEAD PARTIES CANNOT BE DECIDED BY COURT RULINGS"

In his statement on his social media account, Babacan said, "Who will lead political parties is determined not by court decisions, but by the will of members, delegates, and voters. The judiciary cannot be turned into a tool to design politics."

"IF THERE IS NO LEGAL SECURITY, THE COUNTRY SUFFERS"

Emphasizing Turkey's need for legal security and democratic competition, Babacan assessed, "Turkey needs legal security, democratic competition, and respect for the will of the ballot box. If there is no predictability in law, democracy, the economy, and the country all suffer."

Babacan's Absolute Nullity Comment

Amidst successive statements from opposition parties, the decision regarding the CHP convention became one of the hottest topics in politics, and Babacan's remarks drew attention. The DEVA Party leader had previously made assessments about the "absolute nullity" debates in television programs he attended, arguing that debates over judicial intervention in politics harm democracy.

SUCCESSIVE REACTIONS FROM THE OPPOSITION

Following the decision, many opposition parties sent messages of support to the CHP, while legal experts and political circles brought the debate on "judicial intervention in politics" to the agenda. Particularly in the opposition front, statements were made emphasizing that decisions regarding the internal functioning of political parties should be shaped by the ballot box and party will.

WHAT HAPPENED?

The Ankara Regional Court of Justice ruled for absolute nullity regarding the CHP. The 38th Ordinary Convention of the CHP, held on November 4-5, 2023, was decided to be invalidated. 

CHP Chairman Özgür Özel, along with members of the Central Executive Board (MYK) and High Disciplinary Board (YDK), were ordered to be suspended from duty. The court also decided that Kemal Kılıçdaroğlu, along with members of the Party Assembly (PM) and YDK, should provisionally assume duties. With the annulment of the convention, all ordinary and extraordinary conventions held after that date and the decisions made became null and void.

WHAT DID THE COURT RULING SAY?

In the ruling of the 36th Civil Chamber of the Ankara Regional Court of Justice, it was stated: "The provisional suspension from duty of Chairman Özgür Özel, members of the Central Executive Board, Party Assembly members, and High Disciplinary Board members, who assumed office through the convention held on November 4-5, 2023, which is tainted by absolute nullity, and the provisional assumption of duties and reinstatement of Chairman Kemal Kılıçdaroğlu, along with members of the Party Assembly and High Disciplinary Board, who were in office before the convention of November 4-5, 2023, until the decision becomes final."
