COURT OF CASSATION RULING

The 1st Criminal Chamber of the Court of Cassation upheld the aggravated life sentence and 5-year prison sentence given to Can Göktuğ Boz, who killed architect Başak Cengiz, who was walking peacefully on the street in Istanbul on November 9, 2021, with a samurai sword. The Chamber completed the review of the appeal regarding the ruling made by the Istanbul Anatolian 4th High Criminal Court on April 22, 2022. Accordingly, it was decided to uphold the aggravated life sentence given to Boz for the crime of "intentional killing with monstrous feelings or by inflicting torture" without applying any mitigating circumstances.

Boz was also sentenced to 4 years in prison for threatening Kaan Ağaca, who tried to prevent the act against the victim Cengiz, and 1 year in prison for the crime of "purchasing, carrying, or possessing firearms and knives and other tools."

The Chamber's decision stated that Boz carried out his act with the weapon referred to as a "samurai sword," and that there were 12 cutting and piercing tool marks on the body of the victim Cengiz, 6 of which were fatal. The decision noted that the defendant Can stated in his defense that he "decided to commit an act against a woman because he was bored and unhappy," and it was pointed out that a large number of cutting and piercing tools were found in the defendant's home.

The decision stated that on the day of the incident, the defendant Can attacked Cengiz, who was walking on the street, with the samurai sword he took from his home, and despite the victim's resistance, Can continued his act, during which he also threatened Ağaca, who was trying to intervene, by saying, "Don't come closer, I'll stab you too!"
