Hasan Durak, who worked as a sanitation worker at Adana Metropolitan Municipality, believed that one-fourth of his salary was deducted for alimony for two years after his divorce. However, when his ex-wife filed a lawsuit claiming "alimony was not paid," Durak spent some time in prison. Subsequently, it was revealed that the money had actually been used for other transactions by the municipality's company. The company official was sentenced to 1 year and 8 months in prison.

Hasan Durak (60), who works as a cleaning worker at Adana Metropolitan Municipality, divorced his wife in 2013, and at that time the court ruled that 1/4 of his salary should be paid as alimony. Durak, whose salary is deposited from Yeni Yol Katı Waste Services, one of the companies of Adana Metropolitan Municipality, had 1/4 of his salary deducted every month under the name of alimony deduction.

HE WENT TO JAIL WHEN ALIMONY WAS NOT PAID

However, Durak's ex-wife filed an enforcement lawsuit against him for not paying alimony. After learning that the deductions made from his salary were not going to alimony as a result of the lawsuits filed against him, Hasan Durak went to prison. After staying in prison for a while, Durak was released after paying his debts and applied to the Adana 4th Heavy Criminal Court through his lawyer Nazan Akça.

A public lawsuit was filed against company official H.İ.Y., and in his statement in court, H.İ.Y. said in his first statement, "We experienced financial difficulties during the mentioned period, we used the enforcement deductions for SGK premiums," but in his other statement, he claimed he had no knowledge of the incident. The court sentenced him to 1 year and 8 months in prison and a fine of 5,000 lira for the crime of "abuse of trust due to service" in 2022. H.İ.Y. appealed the decision, but the Adana Regional Court of Appeals 9th Criminal Chamber upheld the decision.

Lawyer Nazan Akça, who made statements regarding the issue, said, "Our client divorced his wife in 2013. Alimony was ruled for his wife. However, our client's salary has been continuously underpaid between 2017-2019. It appears on the payslip that 1/4 of his salary was deducted for alimony. Our client is very comfortable about this because he knows it was deducted for alimony. After this, he sees that a case was opened against him in the enforcement criminal court on the grounds that alimony was not paid. He then appeals to the court, stating that alimony was deducted. However, the court sentenced our client to prison because it determined that alimony was not paid in the enforcement file," she stated.

Akça, who also explained that a public lawsuit was filed and the company official was punished, said, "We paid these amounts to get our client out of prison while he was in jail. However, after we learned that these files were actually under the company's responsibility and that the amounts deducted from our client's salary were not paid into the enforcement file, we filed a criminal complaint with the Adana Chief Public Prosecutor's Office. Following the criminal complaint, the Adana 4th Heavy Criminal Court opened a public lawsuit against the official who deducted the salary and did not deposit it into the enforcement file. In this case, a sentence of 1 year and 8 months in prison and a fine of 5,000 lira was imposed," she said.

ALIMONY IS A RESPONSIBILITY

Akça also advised citizens not to be victimized, saying, "They should not think that my alimony is being deducted from my salary anyway. They should definitely check whether money has been deposited into the enforcement file. Alimony does not normally result in imprisonment unless an additional commitment has been made due to debt. However, since alimony is a responsibility, if it is not paid, one may face imprisonment. Otherwise, one day they may be contacted by law enforcement and taken to prison, saying, 'there is a judgment against you'."
