The Deputy Chairman of the AK Party, Mustafa Şen, announced the report that will be presented to the Process Commission within the scope of "Terror-Free Turkey." Şen stated, "The report we will submit to the commission will also include the return home arrangement. There will be a 5-year judicial control condition for those who will benefit from the arrangement."
The National Solidarity, Brotherhood, and Democracy Commission of the Grand National Assembly of Turkey presented the AK Party report. AK Party Deputy Chairman and commission member Mustafa Şen explained the legal framework proposed for the "return home" of PKK members in the report prepared by the party.
"IF THE ORGANIZATION DISSOLVES ITSELF, THE CRIME WILL CEASE TO EXIST"
Şen stated that if the organization ceases to exist, the membership in the organization and related crimes will legally fall away, saying, "Membership in the organization is a crime. However, if the organization dissolves itself, this crime ceases to exist. When the organization ceases to exist, the crime of aiding and abetting also falls away." Şen expressed that the sentences of convicted members of the organization will also be evaluated within the same scope.
"ONGOING CASES WILL ALSO BE DISMISSED"
Şen indicated that the regulation would also apply to individuals currently being prosecuted for the same crimes, stating, "If there is an ongoing trial for aiding, abetting, or membership against a member of the terrorist organization, when the organization is dissolved, the case will also be dismissed."
"WE PROPOSE A 5-YEAR JUDICIAL MONITORING CONDITION"
Şen emphasized that all these regulations could be applied under a specific condition, saying, "However, we propose all of this with a condition of 5 years of judicial monitoring."
