In the trial of a teacher accused of violence against a 5-year-old child with atypical autism in Mersin, the expert report revealed that the violence occurred on different dates. The court filed a criminal complaint for a new indictment and decided to continue the defendant's detention.
The detained teacher, who faces up to 2 years and 3 months in prison for allegedly using violence against a 5-year-old child with 'atypical autism' in Mersin, appeared before the judge again. While the expert report stated that the defendant used violence against the child on different dates, the court filed a criminal complaint for the preparation of a new indictment and decided to continue the defendant's detention.
At the hearing at Mersin 25th Criminal Court of First Instance, the defendant S.P.C., who was arrested on April 21 on charges of using violence against Kuzey Yılmaz, who was diagnosed with atypical autism, attended. Yılmaz's family and their lawyers were also present at the hearing.
HE MADE THE VIOLENCE SYSTEMATIC
The judge announced that the expert report containing the analysis of security camera footage related to the incident had reached the court. The judge, stating that the expert had prepared a report indicating that the defendant used violence against the child on different dates, asked the defendant to make a defense regarding the report.
HE SAID HE DID IT "WITH GOOD INTENTIONS"
The defendant S.P.C., stating that he had been Kuzey Yılmaz's teacher for a long time, said, "My touching him, making contact to establish eye contact is normal. My aim was not violence. The things I did with good intentions were perceived differently. This is a sad situation for me. I request my release."
Kuzey Yılmaz's father, Bahattin Yılmaz, stated that his child was not responding to treatments at the hospital and requested that the defendant be punished.
"WE LEARNED FROM THE REPORT THAT THE VIOLENCE WAS CONTINUOUS"
The mother, Sermin Yılmaz, stating that they learned from the expert report that the violence was continuous, said, "We watched the footage with the lawyer. We learned that it was not a one-time thing, and after seeing these images, I understood why my child cried so much. I want the defendant to be punished in the harshest way possible."
CRIMINAL COMPLAINT FROM THE COURT
The court prosecutor, in his opinion, requested that the defendant's detention continue. The court filed a criminal complaint for the preparation of a new indictment, considering the possibility that the violence against the child on different dates, according to the expert report, could change the legal characterization of the crime.
The judge decided to continue the defendant's detention and adjourned the hearing to resolve the deficiencies.
