Abdullah Şehmusoğlu, who killed Evin Demirtaş, the mother of five children in Diyarbakır, was sentenced to life imprisonment with aggravated circumstances. It has been revealed that in the horrific murder, Şehmusoğlu had previously killed his ex-wife and another person, and benefited from a general amnesty in 1974.

SET A TRAP, KILLED

The incident occurred on October 22, 2024, in the Huzurevleri neighborhood of the Kayapınar district. After living together for a while in a religious marriage, Abdullah Şehmusoğlu and Evin Demirtaş separated. Şehmusoğlu began to wait in the street where Demirtaş would pass, following her after she rejected his reconciliation offer. After sitting in a café on the street for about 2 hours, Şehmusoğlu approached Demirtaş when he saw her and pulled out the gun he had brought with him. Noticing the gun, Evin Demirtaş tried to escape. Abdullah Şehmusoğlu shot Demirtaş multiple times as he chased her. While Şehmusoğlu fled, health and police teams were dispatched to the area upon the reports of bystanders. Health teams confirmed that Evin Demirtaş had lost her life. After the autopsy at the Forensic Medicine Institution, Demirtaş's body was handed over to her relatives and buried.

A week after the incident, the teams from the Homicide Bureau of the Public Security Department caught and detained Abdullah Şehmusoğlu at a friend's house where he was hiding with the gun he used in the incident. After his procedures, Şehmusoğlu was arrested by the court he was brought to after being referred to the courthouse.

The trial in which Abdullah Şehmusoğlu is charged with 'intentional killing of a woman' was held at the Diyarbakır 1st Heavy Penal Court. The hearing was attended by the defendant Abdullah Şehmusoğlu, the victim Evin Demirtaş's sister Fatma Çelebi and her children, the lawyers of the parties, and the lawyer from the Diyarbakır Bar Association's Women's Rights Consultation and Implementation Center. In his defense, Abdullah Şehmusoğlu recounted the day of the incident, saying, "I married my wife in 1994, we have been together for 30 years. For the last 3 years, there was something strange about her; she sold the house and left. I had no contact or communication with my wife. My children spoke with their mother, and she told them, 'I got married.' We had an imam marriage that lasted for 30 years, but we had no official marriage. We have 5 children together. I tried to find her. I had a breakdown in my vehicle, and on the day of the incident, I was trying to find a part at the shop. Then I sat in the café and had tea, and I saw my wife coming from across the street. She saw me and came about 2 meters close. I asked her, 'Is what you said true?' She replied, 'Yes, I married someone, I have no interest in you anymore, if you have any honor or dignity, don't come in front of me again.' When I said, 'How can you do this to me?' she said, 'Do whatever you can, the person I married is younger than you.' When I heard this, my world collapsed, and I lost my mind. In that moment, I tried to leave, but I followed her, and she didn't stop. I tried to stop her, pulled out my gun, and said, 'Stop, why did you do this?' She said to me, 'Are you a man, do you have the courage to shoot?' At that moment, I shot twice, and she fell to the ground. I continued to shoot out of reflex, saying, 'Did you not fear God, do you have no mercy, are you not ashamed at all?'

FIRED 17 SHOTS AT EVİN

After the defense of Şehmusoğlu and the testimonies of witnesses were heard, the public prosecutor presented his opinion on the case. In the opinion, it was stated that while Evin Demirtaş was shopping at a market and heading home, the defendant Abdullah appeared in front of the victim and intentionally killed Evin by firing a total of 17 shots at various parts of her body, first 3-4 shots, then changing the magazine. It was also noted in the opinion that Evin Demirtaş's three children stated that they were not complaining about their father, that there were also camera images of the incident, and that Şehmusoğlu surrendered the gun he used in the incident when he was caught, and it was determined that all 17 bullets found at the scene were fired from the submitted gun.

SENTENCED TO LIFE IMPRISONMENT

The court panel, after the witness statements and the defenses of the lawyers, decided to sentence the defendant Abdullah Şehmusoğlu to life imprisonment for the crime of 'intentional killing of a woman' against the victim Evin Demirtaş, in accordance with Article 82/1-f of the Turkish Penal Code, which corresponds to his actions.

The court panel also ruled that there was no place for the application of unjust provocation conditions, considering the defendant's statement that he had previously killed his wife and another person and was released after benefiting from the general amnesty in 1974, the intensity of intent demonstrated by firing 17 shots, the severity of the manner in which the act was committed, his cold-bloodedness, and the lack of remorse, leading to the conclusion that there was no positive opinion in court regarding the possibility of reoffending, thus deciding that there was no place for a discretionary reduction in accordance with Article 62/1 of the Turkish Penal Code.

It was decided to sentence Şehmusoğlu to 2 years in prison and a fine of 50 days for the crime of possession of a firearm, taking into account the manner in which the crime was committed, as well as the importance and value of the subject of the crime.
