The landlord, stating that the expert determined the monthly rent as 2,000 TL instead of 20,000 TL and that the eviction lawsuit was also rejected, said he had to pay 41,000 TL in attorney's fees to the opposing party's lawyer.

A citizen who purchased an apartment in Mersin that had a tenant claimed that he has been unable to enter his home or collect rent for about 2 years. Stating that the lawsuit he filed for the tenant’s eviction was rejected, the citizen said he was forced to pay 41,000 TL in attorney fees to the opposing party and requested that his grievance be remedied.

The incident occurred in an apartment building at 3216 Street in the Çiftlikköy Neighborhood of the Yenişehir district. According to the allegation, Ramazan Merveyanoğlu purchased an apartment on the second floor of the building on January 29, 2025, in which a foreign national tenant was living. Merveyanoğlu, who stated that after purchasing the house he sent a notice to the tenant through a notary, alleged that despite the notice, the tenant did not vacate the house and did not make any rent payment to him.

HE CANNOT ENTER HIS HOME OR COLLECT RENT

Recounting his experience, Merveyanoğlu stated that he has had problems with the tenant since the date he purchased the house and said, “I bought an apartment on the second floor of the building in the Çiftlikköy Neighborhood of the Yenişehir district of Mersin. When I bought it, it had a tenant, a foreign national. I sent him a notification through a notary. It has been about 2 years since I bought this house; I can neither enter my house nor collect the rent for my house. I am currently a victim.”

THE EXPERT DETERMINED THE RENT AS 2,000 TL

Merveyanoğlu, who stated that they applied to court to have the tenant removed from the house but could not obtain the result they wanted, also reacted to the rent amount in the expert report prepared during the trial. Merveyanoğlu said, “We applied to court to obtain an eviction decision through the court. The court requested an expert report. Based on the expert report, the rent here, which should normally have been 20,000 TL, was determined as 2,000 TL. Our tenant did not pay rent in any way. We requested the eviction of the house. We cannot collect rent, and the judge rejected the case.”

ON TOP OF THAT, 41,000 TL IN ATTORNEY FEES WAS ADDED

Stating that after the court rejected the eviction request, he had to pay attorney fees to the opposing party’s lawyer, Merveyanoğlu said, “Accordingly, an attorney fee was also charged to me. I also have to pay 41,000 TL in attorney fees to the opposing party’s lawyer. I am both the property owner and I am paying extra money. I have not been able to collect rent for 2 years either. I am a victim. We initiated legal proceedings for my grievance, but unfortunately we have not been able to reach a conclusion.”
