An indictment has been prepared in the traffic accident in Giresun that resulted in the death of 16-year-old Tuana Elif Gülüşan Torun. The Giresun Chief Public Prosecutor's Office filed a public lawsuit against the driver Adem Hasbaş, who had a blood alcohol level of 1.97 promille, was speeding excessively, and applied the brakes after the point of impact, characterizing his action as "homicide by probable intent." In this incident, which was not deemed a "simple accident," Adem Hasbaş will be tried in the heavy penal court.
In the Görele district of Giresun, the investigation into the traffic accident that caused the death of 16-year-old Tuana Elif Gülüşan Torun, the victim of the sexual harassment case in which the former mayor was being tried, has been completed. The Giresun Chief Public Prosecutor's Office stated that the incident cannot be considered a simple traffic accident and filed a public lawsuit against the suspect Adem Hasbaş for the crime of "homicide with possible intent." The indictment emphasized that the suspect had a blood alcohol level of 1.97 promil at the time of the incident, alcoholic beverages were found in the vehicle, he was driving at high speed, brake marks started after the point of impact, he fled the scene after the accident, and considering all evidence together, although he could have foreseen the fatal outcome, he continued driving.
INDICTMENT SENT TO HEAVY PENAL COURT
The Giresun Chief Public Prosecutor's Office completed the investigation into the incident that occurred on March 28, 2026, in the Görele district and resulted in the death of Tuana Elif Gülüşan Torun. In the prepared indictment, a public lawsuit was filed against the suspect Adem Hasbaş for the crime of "homicide with possible intent" under Articles 81/1 and 21/2 of the Turkish Penal Code. The case file was registered in the indictment evaluation queue of the Giresun 3rd Heavy Penal Court as 2026/127.
ACCORDING TO THE PROSECUTOR'S INDICTMENT, THIS IS NOT A SIMPLE TRAFFIC ACCIDENT
The indictment stated that the incident occurred as an isolated traffic accident; no evidence was obtained that the suspect followed Tuana Elif Torun, directed her to the accident site, or acted with third parties. However, the prosecutor's office, evaluating the manner of the accident and the suspect's behavior together, concluded that the case does not fall under "involuntary manslaughter."
In the indictment, it was emphasized that Adem Hasbaş had a blood alcohol level of 1.97 promil at the time of the incident, continued driving the vehicle, had been driving fast before the incident, refused the offer of the person with him to drive instead, and despite all risks, remained behind the wheel.
ALCOHOL IN THE VEHICLE, BRAKE MARKS ON THE ROAD, SERIOUS FINDINGS IN THE CASE
In the crime scene investigation, it was recorded that the vehicle involved in the accident, with license plate 28 RE 752, was found abandoned at the scene. The inspection of the vehicle revealed a small glass with unfinished alcohol on the right glove compartment, full beer cans on the right floor mat, an unopened beer bottle by the handbrake, and an unopened beer can next to the gear shift. Examinations at the scene noted 34 meters of brake marks starting after the point of impact, the vehicle stopping in a way that blocked the left lane, a broken right front signal light, a missing right side mirror, a dent between the right fender and door, and a broken right side of the windshield.
SECOND-BY-SECOND ANALYSIS OF CAMERA RECORDS
As part of the investigation, camera footage showing the accident scene, travel routes, and the movements of the parties before the accident was analyzed. According to camera analysis, it was determined that Tuana Elif Torun left her residence alone around 22:10, walked towards the coast, and attempted to cross the state highway at the time of the accident. The vehicle driven by suspect Adem Hasbaş was determined to have left a location in front of Yakamoz Büfe shortly before the incident, traveled along Mebus Şevket Bey Street towards Trabzon, then proceeded to the coastal road, and struck Tuana Elif Torun at around 22:18:38.
WITNESS: HE WAS GOING 140-150 KM/H, I GOT SCARED AND GOT OUT OF THE VEHICLE
The indictment also included the statements of Mehmet Ali Emanet, whom the suspect met during the day. Emanet recounted that on the day of the incident, he met with Adem Hasbaş, they drank alcohol, set off together in the vehicle, and that Hasbaş was driving very fast, at speeds of 140-150 km/h, and because he was driving under the influence of alcohol, he got scared and got out of the vehicle.
It was stated that the same person's phone conversation with Adem Hasbaş after the accident was also included in the case file. In the call recordings, Hasbaş reportedly said that he had an accident, hit a girl, and was scared.
HE REFUSED THE OFFER "LET ME DRIVE"
The statement of Yusuf Hasbaş, who was a passenger in the vehicle, also included striking details. Yusuf Hasbaş said that Adem Hasbaş was drunk, and although he offered to drive the vehicle himself, Adem Hasbaş did not accept. The prosecutor's office considered this statement as one of the important pieces of evidence in the assessment that the suspect knew he was drunk, nevertheless continued driving, and accepted the severe consequences that could occur.
FORENSIC MEDICINE: DEATH DUE TO GENERAL BODY TRAUMA; ASSESSMENT OF POSSIBLE INTENT, NOT NEGLIGENCE
Tuana Elif Torun was taken to the hospital with serious injuries after the accident. She passed away on March 30, 2026.
In the forensic medicine report, it was determined that Tuana Elif Torun's death resulted from brain hemorrhage and brain tissue damage, along with cervical vertebra, rib, and extremity fractures due to general body trauma.
In the traffic expert reports included in the case file, assessments were made that Tuana Elif Torun had a primary fault and suspect Adem Hasbaş had a secondary fault. However, the prosecutor's office stated that the degree of fault and the moral element of the crime should be evaluated differently, and the legal classification of the incident was based on the provisions of "possible intent."
In the indictment, it was stated that despite having a blood alcohol level of 1.97 promil, the suspect drove the vehicle, there were findings that he continued drinking alcohol while driving, he did not comply with speed limits, made phone calls, drove a vehicle with limited safety equipment relying on his own driving skills, and although he could foresee an accident resulting in death under all these conditions, he continued his action.
The indictment also requested that discretionary reduction provisions not be applied to the suspect, considering the reaction and outrage the incident caused in society, its nature offending public conscience, and the manner of the crime. It was stated that the suspect Adem Hasbaş's detention continues. The trial process regarding the death of Tuana Elif Torun is pending at the Giresun 3rd Heavy Penal Court.
It is expected to begin after the evaluation of the indictment by the Heavy Penal Court.
