The legal regulation prepared for the "Terror-Free Turkey" process has been completed, and the draft law, named the "Framework Law," has been submitted to the Speaker's Office of the Parliament. The draft law, titled the "Law Proposal on Strengthening National Solidarity and Social Cohesion," consists of 12 articles.
With the completion of the draft, the question that the public and especially prisoners and their relatives were most curious about, "Will there be conditional release?", has also been answered.
WHAT IS THE PURPOSE OF THE PROPOSAL?
The proposal aims to determine the procedures for postponing ongoing investigations and prosecutions, as well as the execution of imposed convictions, along with other procedures to be carried out, following the determination by security institutions that the PKK/KCK terrorist organization and all related formations have ended their de facto existence and have surrendered all weapons and ammunition under their control, and the publication of the National Security Council Decision confirming this determination in the Official Gazette.
WHO WILL BE ABLE TO BENEFIT FROM CONDITIONAL RELEASE?
According to the regulation, only those who have committed the crimes of "establishing or leading the PKK/KCK terrorist organization," "being a member of the organization," "knowingly and willingly aiding the organization," "making propaganda for the organization," and "financing terrorism" will be able to benefit from conditional release, provided that the specified conditions are met. However, "intentional homicide offenses" committed on behalf of this organization will not be within this scope, and those who commit murder on behalf of the organization will not be able to benefit from conditional release.
WHAT WILL THE CONDITIONS FOR CONDITIONAL RELEASE BE?
According to the proposal, provided that security institutions determine that the organization has ended its de facto existence and has surrendered all weapons and ammunition under its control, and that the National Security Council Decision confirming this determination is published in the Official Gazette; investigations and prosecutions conducted for the intentional homicide offense committed within the framework of organization activities, and for crimes requiring life imprisonment or aggravated life imprisonment committed before June 1, 2005, will not be included in the scope of conditional release.
Investigations and prosecutions for crimes within the scope of the proposal that require a penalty of 15 years or less will be postponed for 5 years, and investigations and prosecutions for crimes requiring more than 15 years of imprisonment, life imprisonment, or aggravated life imprisonment will be postponed for 10 years.
IF NO CRIME IS COMMITTED DURING THE POSTPONEMENT PERIOD, A DISMISSAL DECISION MAY BE ISSUED
For files under review through the appeal or cassation legal remedies regarding crimes for which a postponement decision will be made, a reversal decision will be issued.
If one of the terrorist crimes is committed within the postponement period starting from the date of the postponement decision, the postponement decision will be lifted, and the investigation and prosecution will continue. In the case of a conviction, the execution of the imposed penalty will not be postponed under the relevant provision of the regulation, and all consequences of the conviction will take effect. If the specified period is spent without committing a crime, a decision of no place for prosecution or a dismissal decision will be issued.
