In addition, in the case of violations of more than one rule, a separate penalty will be imposed for each offense, and in scooter-related violations, for each vehicle.
The Regulation on Amendments to the Electric Scooter Regulation prepared by the Ministry of Transport and Infrastructure, the Ministry of Environment, Urbanization and Climate Change, and the Ministry of Interior was published in the Official Gazette and entered into force.
PENALTY UP TO 170,000 TL FOR BUSINESSES EXCEEDING THE SCOOTER NUMBER LIMIT
According to the regulation, if electric scooter businesses fail to comply with the limits on the number of vehicles they may keep in the areas where they have obtained permits, graduated fines will be imposed.
During the March-October period, businesses will not be allowed to have fewer than 70 percent or more than 130 percent of the permitted number of scooters. During the November-February period, the lower limit will be applied as 40 percent and the upper limit as 130 percent.
Businesses acting contrary to these limits will be fined administrative fines of 8,687 TL for the first violation, 86,900 TL for the second violation, and 170,000 TL for the third violation. The activities of businesses penalized for a third violation within the scope of their authorization certificate will also be temporarily suspended for 6 months.
50,000 TL PENALTY FOR BUSINESSES THAT FAIL TO SUBMIT DOCUMENTS DURING INSPECTION
Businesses that fail to present the information or documents requested by authorized officials during inspection will be subject to an administrative fine of 50,000 TL.
If other obligations in the regulation are violated, an administrative fine of 8,687 TL, 43,447 TL, or 86,900 TL will be imposed according to the relevant rule.
A SEPARATE PENALTY WILL BE IMPOSED FOR EACH SCOOTER
With the new regulation, it was decided that if multiple rules are violated at the same time, a separate penalty report will be prepared for each offense. For violations committed with electric scooters, administrative fines will also be imposed separately for each vehicle.
PENALTY REPORTS MAY BE PREPARED ELECTRONICALLY
It was also made possible to issue reports regarding administrative fines electronically. The procedures and principles for preparing electronic reports will be determined by the relevant administration.
