IT WAS TO BE DELIVERED IN 2013, 13 YEARS HAVE PASSED AND THERE IS NO PROJECT
Yeşil Real Estate Investment Trust Inc. (Yeşil GYO) sold the Innovia project, which was announced to include 6,500 residences and be built in Esenyurt, Istanbul, from the model in 2010 and 2011. Although it was stated that the apartments would be completed and delivered in 2013, they have not been delivered despite 13 years having passed.
It was claimed that Yeşil GYO collected more than approximately 300 million dollars from 4,000 people at that time. Despite using a 600 million TL loan from Halkbank, the company did not complete the construction and did not deliver the residences.
VICTIMS APPLIED TO THE JUDICIARY
The 4,000 people who were victimized while trying to buy apartments from the project started a legal battle. Citizens who gave all their savings to Yeşil GYO with the dream of becoming homeowners and became housing victims filed a criminal complaint with the Istanbul Chief Public Prosecutor's Office.
In the criminal complaint, it was requested that Yeşil GYO's managers Adnan Başkır, Cengiz Dilli, Günay Yavaş, Işık Gökkaya, Kamil Engin Yeşil, Kurtuluş Akyüz, Namık Bahri Uğraş, and Uğurcan Giray be tried for the crimes of "Fraud by persons who are merchants or company managers or acting on behalf of the company during their commercial activities; establishing/being a member of an organization with the aim of committing a crime within the scope of cooperative managers' activities."
NON-PROSECUTION DECISION GIVEN FOR COMPLAINTS
However, on August 20, 2026, the prosecutor's office decided "no room for prosecution" for these complaints as well, on the grounds that a similar criminal complaint had previously been made to the Bakırköy Chief Public Prosecutor's Office and a "no need for prosecution" decision had been given.
The non-prosecution decision included the following statements:
"When the entire file content is evaluated together; since there is no possibility to file a new public lawsuit regarding the qualified fraud claims attributed to the suspects through the Innovia-4 project, which is the subject of the complainants' complaint, unless the previous non-prosecution decision is overturned, it has been decided that there is no place for prosecution regarding the suspects and crimes named above."
