After being detained in Istanbul for the crime of "being a member of the armed terrorist organization PKK/KCK," Ahmet Özer, who was removed from his position as the Mayor of Esenyurt, has had his lawyers request the Istanbul Chief Public Prosecutor's Office to provide them with a copy of the MASAK report and the statement of the confidential witness in the investigation. RETURN OF ÖZER'S BELONGINGS HAS ALSO BEEN REQUESTEDLawyers Hasan Sınar and Hüseyin Ersöz submitted a petition to the Prosecutor's Office regarding these requests. In a separate petition submitted to the Istanbul Duty Magistrate, it was claimed that the items seized during searches at Özer's home, the mayor's office, and his vehicle were taken unlawfully, and it was stated that these should be returned to them without any further action. "HE WAS DETAINED WITH EVIDENCE THAT DOES NOT CONSTITUTE A CRIME"Lawyer Hasan Sınar stated in a press statement made to reporters at Çağlayan Square that his client was detained with abstract and concrete evidence that does not constitute a crime and does not fulfill the material elements of the alleged offense. He mentioned that the rejection of the objection made regarding this matter has led to the process of applying to the Constitutional Court. Sınar said, "Our opinion on this matter is that the abstract and unfounded allegations made against our client Ahmet Özer do not create sufficient suspicion of a crime in any way, and therefore, an immediate release and a decision of no grounds for prosecution should be made regarding our client." Sınar added that if the prosecution holds a different opinion, they have requested the preparation of an indictment and the transition to the prosecution phase, as well as the lifting of the restriction decision to allow them to fully understand the charges against their client and to create a defense accordingly. Lawyer Hüseyin Ersöz stated, "We also have a request for both the documents that are not covered by the restriction decision and the matters and evidence cited as reasons in the detention decision to be provided to us in the same manner."
