Lawyer Ruşen Gültekin made striking statements regarding the detention procedures applied to journalist-writer Rasim Ozan Kütahyalı. Gültekin argued that the process, from the detention decision to the use of handcuffs, was contrary to procedural law.
“RIGHT NOT TO BE STIGMATIZED WAS VIOLATED”
Sharing on his social media account, Gültekin said, “All procedural actions, starting from the detention decision of Rasim Ozan Kütahyalı, including the handcuffing procedure, are against procedural law. The right not to be stigmatized has been violated.”
The statement noted that the images reflected in the public eye particularly damaged personal rights, and claimed that the principle of proportionality was ignored during the detention process.
“CONCRETE JUSTIFICATION REQUIRED FOR HANDCUFFS”
Gültekin stated that according to criminal procedure practices, concrete justifications such as suspicion of escape or the likelihood of harming the surroundings are required to handcuff a person. The lawyer argued that these conditions were not met in the current case and expressed that the applied procedures were unlawful.
