With the change regarding the records containing the termination codes of the Social Security Institution (SGK), the termination codes were removed from the service breakdown documents provided to employers; it was learned that the decision came into effect after the Council of State's annulment ruling regarding the "morality and good faith" code.

An important change has been made that affects millions of employees regarding SGK records. It has been learned that the codes and explanations related to the reasons for termination have been removed from the SGK Registration and Service Statement / Workplace Title List document obtained through e-Government.

TERMINATION CODES REMOVED FROM THE DOCUMENT

A change has been made to the document regarding termination codes, which were reported to cause problems for employees in the new job search process. Accordingly, the SGK Registration and Service Statement / Workplace Title List presented to employers no longer includes termination codes and reasons for dismissal.

COUNCIL OF STATE DECISION WAS EFFECTIVE

In its decision dated October 14, 2024, the Council of State examined the code of "violation of moral and good faith rules" found in SGK records. The court stated that this code is based on the employer's unilateral declaration, that unverified claims have been recorded in official records, and that this can have negative effects on working life, ruling that the regulation is contrary to the Personal Data Protection Law and the right to work.

THE INDIVIDUAL SEES, THE INSTITUTION DOES NOT

According to the news on NTV, in the SGK service statement inquiries made through e-Government, termination codes can be seen by the employee. However, these codes and explanations are no longer included in the official SGK documents provided to employers.

TERMINATION NOTIFICATION IS ON THE AGENDA

On the other hand, it is stated that the reasons for dismissal are still included in the termination notification requested by the employer from the employee during the recruitment process. It is expressed that the Council of State may also make a decision regarding this document in the future and that the removal of codes and explanations under the Personal Data Protection Law may come to the agenda.
