Regarding a 24-year-old university student living in Mardin, two separate lawsuits were filed in different provinces for fraud cases involving the same complainant. The suspect received an acquittal in one case and an arrest warrant in the other, sparking controversy.

Bünyamin D, a 24-year-old living in Mardin, allegedly gave his IBAN as requested after his friend Özgür Ç. told him that his bank accounts were blocked and seized. 

THE IBAN HE GAVE TO HIS FRIEND BACKFIRED

In the fraud case involving the given IBAN, Tahir K., claiming to be the victim, filed complaints with the Balıkesir and İzmir Chief Public Prosecutor's Offices. Following the complaint, an investigation was launched against 7 people, including Bünyamin D, who was arrested. The indictment prepared within the scope of the investigation was sent to the Balıkesir Criminal Court of First Instance. The indictment stated that money transfers were made from the complainant's account through the suspects' accounts.

In the indictment, it was stated that Bünyamin D declared that he did not know the complainant, that the account in question belonged to him, that he gave it to his friend Özgür Ç. trusting him after the friend claimed his bank accounts were blocked and seized, that his account was later blocked, that he had no involvement in the fraud incident, and that he did not accept the allegations made against him.

“A PERSON CAN ONLY BE TRIED ONCE FOR A CRIME”

Lawyer Gurbet Bilbay stated that her client is being tried in two different provinces for the same crime in two separate cases. Bilbay stated that the damage was to the same complainant, that the complainant withdrew the complaint, and that the damage was paid, but her client was still arrested. Lawyer Bilbay claimed that despite making numerous requests on this matter, nothing was done, saying, “In the same case, a different defendant paid the damages and was released, but my client is still inside. A person can only be tried once for a crime. This is a rights violation according to the Constitutional Court. The Constitutional Court states that this situation needs to be corrected due to the principle of fair trial.”

“WE FILED A CRIMINAL COMPLAINT AGAINST THE ACTUAL PERPETRATOR”

Bilbay, saying, “My client has been victimized twice,” continued her speech as follows: “We filed a criminal complaint against the actual perpetrator. He also went to prison. There are many victims too. We also presented evidence regarding this. But my client, let alone being tried for one case, is being tried twice. 

“ARRESTED IN ONE CASE, NOT ARRESTED IN THE OTHER”

My client is currently in Mardin Prison. One of his cases is in İzmir, the other case is in Balıkesir. But one of these cases is at the trial stage, the other at the investigation stage. He is arrested in one and not arrested in the other. We are in such a huge contradiction. Moreover, my client is a student. I have also submitted documents proving he is a student. Indeed, there is a decision by the Court of Cassation. Even when a person used such a method to earn pocket money, they were acquitted. Even though my client did not intentionally take this path and was deceived by his friend, he is still being tried.”
