In Antalya, the trial of former Aksu Municipality Building Inspection Director Nevzat Avcı, who made a sexual proposition to a woman in exchange for the cancellation of the demolition decision of her workplace and revealed those images, continues. Avcı, who appeared before the judge, denied the charges, while the woman recounted her experiences in court. RELATIONSHIP WITH THE MUNICIPALITY WAS TERMINATED WHEN THE IMAGES EMERGEDThe footage of the moments when Aksu Municipality's Building Control Director Nevzat Avcı asked for sexual intercourse from the owner of a business, Faten E., who is of Syrian nationality, in order to lift the demolition decision of a building last February, became a topic of discussion on social media. After the footage emerged, former Aksu Mayor Halil Şahin dismissed Avcı and terminated his relationship with the municipality. PREVIOUSLY REPORTED TO CIMER SEVERAL TIMESIt is alleged that Nevzat Avcı, who had committed numerous acts of corruption before the incident and was reported to the prosecutor's office and CIMER by many people, continued to hold his position despite the findings in the reports of the Ministry of Interior Inspection Board and the Court of Accounts. Nevzat Avcı, who was found to have negotiated in exchange for sexual intercourse, was arrested and sent to prison. UP TO 6 YEARS IN PRISON FOR BRIBERYAn indictment was prepared against Nevzat Avcı by the Antalya Chief Public Prosecutor's Office. The indictment, prepared with a demand for up to 6 years in prison for Nevzat Avcı on charges of "demanding a bribe," was accepted by the 6th Heavy Penal Court. "IT DID NOT GO BEYOND MUTUAL BANTER"Nevzat Avcı, the defendant, participated in the hearing at the 6th Heavy Penal Court in Antalya via SEGBIS. Avcı stated in his defense that he did not accept the indictment and the charges against him. Nevzat Avcı claimed that Faten E., the complainant, made an illegal offer to him for the cancellation of the demolition of an illegal structure and the cancellation of the zoning fine, saying, "When the conversations in the video are examined, it will be seen that the requested things did not happen, there was no agreement. The conversations did not go beyond mutual banter. There is no legal reality. I did not take a bribe. I did not meet anywhere. I did not direct anyone to a third party. There was no money involved." "IN MY 39 YEARS OF CIVIL SERVICE, NO INVESTIGATION HAS BEEN CONDUCTED"Avcı stated that according to the regulations, giving a demolition decision and imposing a fine is the duty and authority of the municipal council, and said, "When the documents received from Aksu Municipality are examined, it will be seen that I have the authority to issue business opening permits and I have delegated authority to several directorates. However, I have not served as a council member since 2011. It will also be seen in these documents that I did not sign any decision. In my 39 years of civil service subject to Law No. 657, no investigation has been conducted on me for any shameful crimes. I request acquittal and release from the charges." COMPLAINANT WOMAN DESCRIBED WHAT HAPPENED IN COURTThe complainant, Faten E., explained that she lost the permit of her business and went to Aksu Municipality to apply for a work permit. Faten E. stated that she met with a woman at the municipality and was then directed to the defendant Nevzat Avcı. She said, "The woman said to me about the defendant, 'Let me ask if he accepts, I will let you know.' I was sitting next to the woman. The defendant came and said, 'Is it you?' I said, 'Yes.' He asked, 'What do you want?' I said, 'I lost my permit, can you give me a new one?' He asked, 'Why?' I said, 'I need it for a work permit.' He asked, 'What if I don't give it to you?' I said, 'Then I won't be able to get a work permit.' He prepared the documents. Then he came back. The demolition decision had been issued. He said, 'There is a fine of 180,000 liras, why didn't you pay?' Then he said, 'Come to my office, let's have coffee.' I said, 'I have work, I have to leave.' He said, 'You can't leave without having coffee.' I said, 'Okay.' I went and sat down. There was a woman in the room. She left. After that, he said, 'You have a demolition decision. The shop will be demolished.' I asked, 'What should I do?' He said, 'It's up to you.' I didn't understand, but I said, 'I have to go.' He said, 'Okay. I will come to the shop. I will have breakfast or drink tea.' I said, 'Okay.' He asked for my number. I gave him my phone number. He said, 'If I can't find you at the shop, I will call you.' So, I left." WHEN SHE ASKED "WHAT WILL HAPPEN," SHE RECEIVED THE ANSWER "IT'S UP TO YOU"Faten E. explained that Nevzat Avcı came to the shop around 10-11 o'clock on the second day and continued her statement as follows: He said, 'The shop will be demolished, it won't exist anymore.' I said, 'My husband is in prison, please don't do this.' He said, 'It's up to you.' He sat down, I served tea. I sat down too. I said, 'What does this mean? I don't understand, can you explain?' He said, 'Okay.' He got up and said, 'One night in a hotel.' I got very angry. I didn't say anything. I said, 'Okay.' He got in his car and left. I thought about why he was asking me for such a thing, maybe because I don't have anyone, maybe he knows that I don't have anyone and my husband is in prison. Even though he didn't see anything from me, he directly made the offer. I said to myself, 'I will go to the municipality tomorrow.' Because I was angry, I recorded the audio and video. In the video recordings, he uses expressions like 'one night, five nights.' I couldn't say anything, I recorded the video." HEARING ADJOURNEDAfter the examination of the parties' lawyers and witnesses, the hearing was adjourned with the decision to continue the defendant Nevzat Avcı's detention.
