Shocking report from Forensic Medicine for the nurse who stood up Türkiye

In the case of nurse Hazel Dırık Bağrıyanık, who was arrested on charges of applying violence to Deniz Esin Bozoklar while in an incubator in Kahramanmaraş, causing her to become mentally and physically disabled, the report prepared by the Forensic Medicine Institute was included in the case file. The report stated that no causal link could be established between the incident in question and the child's disability. The mother, stunned after the report, criticized the decision, saying, 'Am I guilty for putting my child in the hospital?'

Sema Bozoklar, who gave birth at Kahramanmaraş Sütçü İmam University Health Application and Research Hospital 5 years ago, brought her daughter Deniz Esin into the world. The baby, born weighing 990 grams, was placed in an incubator in the neonatal intensive care unit. On May 26, 2021, on-duty nurse Hazel Dırık Bağrıyanık beat Deniz Esin Bozoklar while trying to draw blood. Five days after the incident, on May 31, 2021, another nurse noticed bruising on Deniz Esin Bozoklar's leg, and the incident came to light.

LEFT WITH MENTAL AND PHYSICAL DISABILITIES

Following this, both a judicial and administrative investigation was launched against Hazel Dırık Bağrıyanık. After being transferred to a private hospital in the city for a while, Deniz Esin Bozoklar was discharged after her treatment there. Doctors told the Abdullah-Sema Bozoklar couple that their daughter had both physical and mental disabilities.

THEY LEARNED VIA E-GOVERNMENT MESSAGE

At the end of the administrative investigation, the university terminated Bağrıyanık's contract, while a lawsuit was filed against her in the Kahramanmaraş 10th Criminal Court of First Instance on charges of 'Intentional injury', seeking up to 3 years in prison. The Bozoklar couple learned that the nurse had subjected their daughter to violence through a message about the hearing date sent via e-Government.

ARRESTED AFTER FOOTAGE SURFACED

While nurse Hazel Dırık Bağrıyanık was being tried without detention, security camera footage of the violence she applied to Deniz Esin Bozoklar on January 21 emerged. In the footage obtained by DHA, the nurse is seen frequently applying violence to Deniz Esin Bozoklar during the 14-minute blood procedure. According to the allegations, the nurse also broke the baby's leg during this time. After the footage emerged, an arrest warrant was issued for Hazel Dırık Bağrıyanık, who did not attend the 7th hearing held on January 23. Surrendering to police in the Dinar district of Afyonkarahisar on January 25, Bağrıyanık was arrested by the court she was brought before and sent to prison.

FORENSIC MEDICINE REPORT ENTERED THE FILE

While Hazel Dırık Bağrıyanık's trial was ongoing, the Forensic Medicine Institute report was also added to the file. The conclusion section of the 62-page report stated the following:

"It is unanimously opined that the psychomotor development delay, epilepsy, and cerebral palsy diagnoses detected in the minor are considered pre-existing conditions in the minor; the assessed brain dysfunctions are of a nature that has no possibility of recovery, but are considered pre-existing conditions; no causal link could be established with the incident in question; the gait disorder, rigidity in both lower extremities, and walking and movement disorder at a level of inability to stand without mechanical support and/or an assistive device, detected as pes valgus in both feet during the orthopedic examination of the minor held at our Board on April 29, are considered pre-existing conditions in the minor; no causal link could be established with the incident in question; and no sequel lesion due to the femur diaphyseal fracture detected in the incident in question was found during the orthopedic examination of the minor held at our Board on April 29, 2026; therefore, no anatomical deficiency or functional disorder of the nature of permanent weakening or loss of function of one of her organs was described or detected."

RELEASE REQUEST REJECTED

After the report was added to the file, Hazel Dırık Bağrıyanık's lawyer, through a petition submitted to the court, stated that his client's continued detention was contrary to procedure and law, and requested her release. The judge rejected the release request on the grounds that there were concrete facts of strong criminal suspicion and that judicial control provisions would be insufficient given the date of the defendant's arrest.

"AM I THE GUILTY ONE FOR GIVING BIRTH AND PUTTING MY CHILD IN THE HOSPITAL"

Sema Bozoklar stated that she was very surprised when she read the Forensic Medicine Institute report, saying, "They find the hospital faultless, they find the nurse faultless, so am I the faulty one here? Am I the guilty one for giving birth and putting my child in the hospital? My child was born, she had no respiratory distress, her brain ultrasounds were clean. For 2.5 months, she had no problems in this way; she was in a stable condition. After 2.5 months, my child is beaten. Five days later, my child's broken leg is noticed, and that night my child has a seizure. The next morning, seizure medication is started. I don't understand why they ignore this."

"WHY WASN'T EPILEPSY MEDICATION STARTED FROM BIRTH"

Bozoklar, stating that no disease or disability was detected in Deniz Esin Bozoklar's examination after birth and that she was placed in an incubator because she was born with low birth weight, said, "If my child was born with epilepsy, if my child was born disabled, why didn't they tell me this or why didn't they take my child under neurological follow-up? They take ultrasounds (USG), the brain USGs are clean. How do you explain this? One month after being beaten, deterioration appears in her USGs. My child's leg remained broken for 5 days, and that night my child had a seizure. The day after the seizure, my child's epilepsy medication is started. If my child had epilepsy from birth, why wasn't this epilepsy medication started from birth? I am asking this to the Forensic Medicine Institute."

"AT LEAST THEY DIDN'T FIND ME AND MY HUSBAND AT FAULT"

Sema Bozoklar continued her speech as follows:

"After the nurse's beating, my child's leg was broken, my child stayed with a broken leg for 5 days like that, and now my child's leg is short and turned inward. Here too, they again find the nurse faultless, again there is no causal link. From the moment my child was born, she has had no signs of disability or epilepsy whatsoever. Everything is normal and stable. She only had vomiting due to feeding, which is what the doctors told me. Now we look at the result, they again find the nurse faultless. Then why did my child's epilepsy start? Why did my child remain disabled? If the shortness and inward turning of my child's leg were something congenital, wouldn't this have come to light? Wouldn't this have been noticed over 2.5 months? We have the images, we have the videos, and in all of them, the child is problem-free."
