Baysan claimed that the money he sent did not reach his daughter. The family's struggle continues, asserting that the money has not been refunded despite the court's decision.

Despite the court's decision, the bank did not refund the 800 dollars. İrem Naz, when she ran out of money at that time, worked as a waitress for a while to make ends meet.

Mother Alper Baysan stated that her daughter was accepted into the Information Technology department of Washington University in 2022, saying, "İrem Naz went to America for education about 2 years ago in August. She was supposed to support herself with the money we sent. We opened an account with a bank in Turkey that has an agreement with America. After the first month, I sent 800 dollars to her account, but my daughter could not withdraw the money there. When we looked at the transaction movements, it appeared as if the money had been withdrawn. We spoke with the bank's customer service, and they said that correspondence was made with the partner bank in America, but after 4 months, they rejected us by saying, 'the money was withdrawn,'" she said.

Baysan expressed that she was victimized because her daughter could not use the money, saying, "My daughter was supposed to meet her needs with that money in America, but she couldn't withdraw it. We couldn't send it again; as a civil servant, I can't send money every time. She tried to survive by working as a waitress for 8-10 dollars an hour there. When she cried on the phone and said, 'Mom, I couldn't withdraw my money,' I felt helpless. As a mother, not being able to reach your child on the other side of the world is a very heavy feeling," she said.

THE CONSUMER COURT FOUND IN FAVOR

Alper Baysan applied to the Consumer Arbitration Board as the process prolonged. The file was later taken to the consumer court. The court found Baysan justified because the bank in Turkey could not access security camera footage from the bank in America and could not prove that the money was actually withdrawn. However, despite the court's decision, the 800 dollars did not transfer to the family's account.

"WE HAVE BEEN FIGHTING FOR 800 DOLLARS FOR 2 YEARS"

The family's lawyer, Tolga Alp Kocaoğlu, said, "Mrs. Alper applied to us in September 2023. First, we went to the Consumer Arbitration Board. It took until May 2024 for the board's decision to come out, and it was decided that the matter needed to be taken to court. Following this, we applied to the Antalya Consumer Court. In the case that lasted about 1 year, the bank could not prove that the money was withdrawn, and the court ruled for the return of the 800 dollars to my client. However, we faced problems during the enforcement stage. Because the decision was made in dollars, collection has not been possible for 2 months. We have been fighting for 800 dollars for 2 years," he said.

Alper Baysan emphasized that despite the court's decision, their victimization continues, saying, "My daughter ran out of money and faced difficulties throughout her education. The court found us justified, but we still cannot get our money. We reached out to the bank multiple times, initiated enforcement proceedings, but we did not get results. We have been struggling for 800 dollars for 2 years," she stated.
