The case of Osman Güler, who went missing in 2017 in the Çınar district of Diyarbakır, has been reopened. As a result of the investigation conducted by the gendarmerie, three suspects believed to be involved in Osman Güler's disappearance have been arrested.
The file related to Osman Güler (20), who went missing on September 3, 2017, in the rural Beşpınar neighborhood of the Çınar district in Diyarbakır, has been reopened by the gendarmerie. In the scope of the investigation, suspects Selahattin Akbuğa and his sons Halil İbrahim Akbuğa and Muhammed Akbuğa were arrested on charges of 'Intentional homicide'. On the other hand, despite the passage of time, Güler's lifeless body has not been found.
Osman Güler, who lived in the rural Beşpınar neighborhood of the district, allegedly went missing after leaving home to irrigate the cotton field on September 3, 2017. Following the family's application, search operations were initiated by gendarmerie teams in the area. Despite the efforts, no trace of Güler was found, and the case was processed as a missing person case for a long time. In 2019, the family claimed that Osman Güler had been kidnapped and filed a complaint. The family stated that Güler's brother had abducted a girl, which led to a feud with the girl's family. In this context, the investigation initiated by the Çınar Chief Public Prosecutor's Office could not progress in the initial phase due to the lack of sufficient and concrete evidence in the file.
JASAT REOPENED THE FILE, CRIME CLASSIFICATION CHANGED
The file was taken up again by the Gendarmerie Crime Investigation Team (JASAT) in 2022. As part of technical and analytical studies, phone records, HTS data, base station signal information, and the statements of the suspects from the day of the incident and before were re-examined. As a result of these evaluations, the file was classified under 'Intentional homicide' instead of 'Deprivation of liberty'. In the scope of the investigation, 8 suspects were detained on February 12 and 13 of this year. After their procedures at the gendarmerie, the suspects were referred to the courthouse. While one of the suspects was released on February 15, four were released under judicial control. Among the suspects, Selahattin Akbuğa, the father-in-law of Osman Güler's brother, and his sons Halil İbrahim Akbuğa and Muhammed Akbuğa were arrested on charges of 'Intentional homicide'.
HTS RECORDS AND CONTRADICTORY STATEMENTS CITED AS REASONS
In the arrest decision of the Peace Criminal Court, it was stated that the HTS records of the suspects from the day of the incident and before, base station signal data, the suspects' statements about having turned off or broken their phones, observations regarding their movements after the incident, and witness testimonies in the file were evaluated together. The decision noted that on the day and hours when Osman Güler went missing, some suspects had given signals at base stations covering the crime scene, and despite some suspects claiming they did not use their phones, these statements did not match the technical data. It was expressed that the vehicle mentioned to have been used in the incident burned in a way that could not be determined one month after the incident, raising suspicions of evidence tampering. Additionally, it was recorded that there was a feud between families due to the kidnapped girl and that some suspects had left the village.
