The Supreme Court overturned the life sentence given to Ayşe Temel, who killed her brother-in-law after he raped her in Konya. The ruling stated that the sentence was inadequately determined and that she should be punished with "aggravated life imprisonment."
In the incident that took place in Konya in 2022, Ayşe Temel, a mother of three, killed her 25-year-old brother-in-law Murat Can Eskici, whom she claimed had raped her for three years.
In the indictment, it was stated that Temel, unable to tolerate this illicit relationship, convinced Eskici to engage in sexual intercourse by promising "we will have a fantasy," tied his hands and feet to the bed, attempted to strangle him with a bag over his head, but when that failed, she killed Eskici by stabbing him multiple times in the abdomen and neck, and also washed the scarves she used to bind him in the washing machine.
HE WAS SENTENCED TO LIFE IMPRISONMENT
Ayşe Temel, who was tried by the Konya 3rd High Criminal Court, was sentenced to life imprisonment for "intentional murder" in July 2023 without any reduction. The 1st Criminal Chamber of the Konya Regional Court of Appeals upheld this decision. Following an appeal by Ayşe Temel's lawyers, the case was sent to the Court of Cassation. The 1st Criminal Chamber of the Court of Cassation found the sentence given to Temel to be unlawful due to insufficient sentencing.
"SAYING 'I WILL HAVE A FANTASY...'"
According to a report by Sabah, in the decision of the Criminal Chamber, it was stated that "Ayşe Temel tied Eskici's hands and feet to the bed with a scarf, saying that she would have a fantasy, put a bag over his head, but the bag tore as Eskici shook his head, and afterwards, she stabbed Eskici multiple times. It was noted that the incident constituted the crime of 'intentional murder against a person who cannot defend themselves physically and mentally,' and therefore, it was found unlawful to rule in this manner without considering that she should be punished with aggravated life imprisonment."
ROMANTIC RELATIONSHIP AND SEXUAL INTERCOURSE
The decision also stated that Murat Can Eskici frequently visited his sister-in-law and that they had a romantic relationship and sexual intercourse, and that although Temel initially consented to the relationship, she later did not want it, but Eskici persisted. It was emphasized that when sentencing Ayşe Temel, the 'unjust provocation' reduction should be applied at the minimum level.
It was learned that Murat Can Eskici had a different surname because he was adopted by another family at a young age. Ayşe Temel will be retried by the 3rd High Criminal Court.
