The Ankara Regional Court of Appeal overturned the first instance court's decision to reject the case filed by the CHP seeking the annulment of the Istanbul Provincial Congress. Due to procedural violations such as making a decision in the absence of a lawyer and issuing a ruling before the deadline for presenting evidence, the case will be re-examined.
The Ankara Regional Court of Appeals 4th Civil Chamber overturned the "rejection" decision given in the case regarding the cancellation of the CHP Istanbul Provincial Congress, which was filed on September 11. The Ankara Regional Court of Appeals 4th Civil Chamber reviewed the rejection decision made by the Ankara 3rd Civil Court of First Instance in the main and consolidated cases filed for the cancellation of the Istanbul Provincial Congress held on October 8, 2023.
OVERTURNED ON PROCEDURAL GROUNDS
In its review, the Chamber found that although the excuse of the plaintiff's lawyer was documented with a health report, the hearing was not postponed, the trial continued in the absence of the lawyer, and it was procedurally incorrect to make a decision before the deadline given to the parties to present evidence had expired. For these reasons, the Chamber annulled the decision of the first instance court. It was decided to send the case back to the local court for retrial. In the overturned decision, it was stated that the annulment was made on procedural grounds due to the violation of the right to legal hearing without entering into the merits of the case.
