In the case where 9 defendants, including one child, were accused of sending threatening messages to the family of Atlas Çağlayan, who was stabbed to death in İstanbul Güngören, the court announced its verdict. The verdict hearing was held in the case where 9 defendants, including one child dragged into crime, who sent threatening messages to the family of 17-year-old Atlas Çağlayan, who lost his life after being stabbed in a fight in Güngören, and who opened a social media account in the victim's name and made posts related to the incident, were tried. After the previous session, there were no detained defendants left in the case. While the defendants and the complainants did not attend the hearing at the Bakırköy 19th Criminal Court of First Instance, the lawyers of the parties were present in the courtroom. Since the defendants did not attend the hearing, their final statements could not be taken. The complainant lawyers who made statements requested the punishment of the defendants, while the defense lawyers requested the acquittal of their clients.
1 DEFENDANT SENTENCED TO 5 YEARS IN PRISON
The court, announcing its decision, ruled that defendant Ömer Faruk Ay be sentenced to 5 years in prison for the crime of 'threat by making oneself unrecognizable together with multiple people, benefiting from the intimidating power of an existing criminal organization'. The court decided that the child dragged into crime, Y.T., be sentenced to 3 years and 4 months in prison for the same crime. The court sentenced defendant Alaa Faysal to 1 year and 3 months in prison for the crime of 'publicly inciting hatred and hostility', and decided to suspend the announcement of the verdict for this sentence. The court ruled for the acquittal of defendant Faysal for the crime of 'publicly disseminating misleading information'. The court sentenced defendant Ömer Can Özdoğan to 2 years and 1 month in prison for the crime of 'unlawfully obtaining or disseminating personal data', and to 11 months and 20 days in prison for the crime of 'publicly insulting the memory of a person', and then decided to suspend the announcement of the verdict for this crime. The court first sentenced defendant Burak Türk to 7 months and 15 days in prison for the crime of 'publicly inciting to commit a crime', and then decided to suspend the announcement of the verdict for this sentence.
4 DEFENDANTS ACQUITTED
The court ruled for the separate acquittal of defendants Abdülsamet Erdoğan and Ferhat Karadağ for the crime of 'threat by making oneself unrecognizable together with multiple people' on the grounds that the act was not proven to have been committed by the defendants. The court ruled for the acquittal of defendant Sevgi Timur for the crime of 'threat by making oneself unrecognizable together with multiple people, benefiting from the intimidating power of an existing criminal organization', and for the acquittal of defendant Ömer Can Derin for the crime of 'threat with the aim of creating fear and panic among the public' on the grounds that the act is not considered a crime by law.
FROM THE INDICTMENT
In the indictment prepared as part of the investigation conducted by the Bakırköy Chief Public Prosecutor's Office, Atlas Çağlayan was listed as 'the deceased', mother Gülhan Ünlü and father Cüneyt Çağlayan as 'complainants', and 9 individuals, one of whom was under 18, as 'suspects'. It was stated that the act was committed by benefiting from the intimidating power created by criminal organizations. In the indictment prepared for the child dragged into crime, Y.T., it was emphasized that the crime committed by the individual fell under 'threat', that the individual committed this crime in a chain-like manner, and that Y.T. carried out the posts by acting in unity of thought and action with his sister and cousin. The indictment stated that the child dragged into crime, Y.T., carried out the threat act through the Telegram channel named 'pkkv404', which includes the name of the terrorist organization PKK, and that the suspect's act also fell under the crime of threat by benefiting from the intimidating power created by criminal organizations.
In the indictment prepared for Y.T., it was requested that he be sentenced to prison for 1 year and 8 months to 8 years and 2 months for the crime of 'threatening by using the names of criminal organizations, making oneself unrecognizable together with multiple people'. The indictment was sent to the Children's Heavy Criminal Court for evaluation. For suspects Ömer Faruk Ay, Sevgi Timur, Abdülsamet Erdoğan, and Ferhat Karadağ, it was requested that they be sentenced to prison for 2 years and 6 months to 12 years and 3 months for the crime of 'qualified threat'. For suspect Ömer Can Derin, a prison sentence of 3 to 6 years was requested for the crime of 'threat with the aim of creating fear and panic among the public through press and broadcast', for suspect Burak Türk, a prison sentence of 9 months to 7 years and 6 months was requested for the crime of 'inciting to commit a crime through press and broadcast', for suspect Alaa Faysal, a total prison sentence of 4 years and 6 months to 10 years and 6 months was requested for 2 crimes, and for suspect Ömer Can Özdoğan, a prison sentence of 2 years, 3 months, and 15 days to 6 years and 4 months was requested for the crimes of 'unlawfully providing or obtaining data' and 'publicly insulting the memory of a person'.
