In the case concerning the killing of 36-year-old Hamdullah Yaman in Bursa by being stabbed in the throat during an argument that broke out in a park, striking statements emerged. The 20-year-old detained defendant Maşallah Tan, for whom life imprisonment is sought, claimed that he picked up the knife on the ground and swung it because he was afraid. After the witness said that the defendant was drunk during the incident, the court decided that the security camera footage should be examined in the criminal laboratory.

The trial continued in Bursa for detained defendant Maşallah Tan (20), who stabbed Hamdullah Yaman (36), with whom he had an argument, in the throat and killed him, and Mücahit Sertkaya (20). Maşallah Tan, for whom a life sentence is sought, said, "During the incident, 2-3 people, together with K.E., were holding me. At that moment, the deceased began running at me while swearing. When I saw this, I got scared and, picking up the knife from the ground, swung it in panic. I had no intention of killing."

FIGHT STARTED BECAUSE OF SWEARING

The incident occurred on March 22 around 17:00 in the Karapınar Neighborhood of Yıldırım district. According to the allegation, an argument broke out because of swearing between Maşallah Tan and Mücahit Sertkaya, who were sitting in Karapınar Park, and Hamdullah Yaman, who was passing by on his motorcycle at that time. In the argument that quickly escalated, Tan stabbed Yaman in the throat. As Hamdullah Yaman collapsed to the ground in blood, nearby people who rushed to help reported the situation to the 112 Emergency Call Center. Upon the report, police and medical teams were dispatched to the area. Yaman, to whom the medical teams gave first aid, was taken to Kestel State Hospital. Yaman, who was taken for treatment, could not be saved.

SURRENDERED TO POLICE

Police teams launched an operation to catch Maşallah Tan, who fled after the incident. While the teams detained Mücahit Sertkaya, the fleeing Maşallah Tan surrendered to police teams. After procedures at the police station, among the suspects sent to the courthouse, Tan was arrested, and Mücahit Sertkaya was given house arrest. Sertkaya was also arrested at the first hearing.

"I DID NOT GIVE A STATEMENT BECAUSE THE POLICE DID NOT CALL ME"

The trial of Maşallah Tan and Mücahit Sertkaya, for whom life imprisonment is sought on the charge of 'intentional killing', continued at Bursa 4th High Criminal Court. Detained defendants and party lawyers attended the hearing. At the hearing, witness M.K., who had not previously given a statement, was heard. When the presiding judge asked, "Why did you not give a statement to the police but are giving a statement here?" M.K. replied, "I did not give a statement because the police did not call me. Later I said I wanted to give a statement to a lawyer. Upon that, I came to the court."

"WE PUT THE DECEASED INTO THE AMBULANCE TOGETHER WITH MÜCAHİT"

M.K., stating that on the day of the incident he had a shave at the barber and then walked toward his home, said, "When I approached the park, I saw K.E. and greeted him. He said in a hurried manner, 'There was a fight ahead, someone died.' I ran there and saw Mücahit Sertkaya. When I asked him what happened, he said, 'Don't you see?' Later, when Mücahit asked, 'Do you know how to perform emergency intervention?' I stated that I did not. I told him to call the ambulance. When the medics came, together with Mücahit we put the deceased into the ambulance." When asked whether there was hostility between the deceased Hamdullah Yaman and the defendants, M.K. said, "I do not know whether there was hostility between him and the deceased. He was on good terms with Mücahit."

"MAŞALLAH WAS DRUNK, HE SWORE"

K.E., who was on the motorcycle together with Hamdullah Yaman, who died on the day of the incident, was also heard as a witness. K.E., stating that Hamdullah Yaman was driving the motorcycle, said, "Everyone involved in the incident is my friend. On the day of the incident, Hamdullah and I were traveling on the motorcycle. Maşallah came across us. Maşallah was drunk, he swore. We got off the motorcycle. Maşallah and Hamdullah began to argue. After I pulled the motorcycle aside, I began to separate them. I separated Maşallah. At that moment, Mücahit came and, thinking that I was fighting with Maşallah, separated us. At that moment, when Maşallah moved toward Hamdullah, Mücahit also went to separate them. At that moment, I saw blood on Hamdullah. Mücahit was shouting, 'What did you do?' He immediately began applying pressure. Then Maşallah walked away. Mücahit called the 112 Emergency Call Center, and then the ambulance came."

"I AM ON GOOD TERMS WITH BOTH SIDES"

After the witnesses were heard, the court panel gave the floor to defendant Mücahit Sertkaya. Sertkaya, stating that he was not a party to the fight, requested his release, saying, "I was separating the fight. I know both sides. I am on good terms with both. The incident happened while I was separating them. I asked M.K. to perform first aid. I have nothing to do with the incident."

"I GOT SCARED WHEN HE RAN AT ME"

Maşallah Tan said, "I do not accept the statements of witness K.E. During the incident, 2-3 people, together with K.E., were holding me. At that moment, the deceased began running at me while swearing. When I saw this, I got scared and, taking the knife on the ground, swung it in panic. I had no intention of killing."

FOOTAGE WILL BE ANALYZED

The court panel decided to send the Kent Security Management System (KGYS) footage related to the incident to the Istanbul Criminal Regional Laboratory for examination of the parties' movements, and to continue the detention of the defendants, and adjourned the hearing.
