A building attendant named İbrahim A., who was tried for allegedly sexually abusing an 8-year-old girl in Antalya, was sentenced to 10 years in prison for the crime of "qualified sexual abuse of a child under twelve" in the first hearing. During the investigation process, the victim's mother, Özlem D., faced a lawsuit for allegedly assaulting the defendant and was also confronted with a compensation claim of 70,000 TL.
The first hearing of the case against Ibrahim A., the apartment attendant who is accused of sexually abusing an 8-year-old girl in the Kepez district of Antalya, was held at the Antalya 3rd High Criminal Court.
While the victim's family and lawyer Demet Burcu Ünal were present in the courtroom, the defendant Ibrahim A. also made his defense alongside his lawyer Sedat Pınarbaşı. As the statements of the parties were heard during the hearing, the court panel announced its ruling at the first session.
DEFENSE CLAIMING "SLANDER"
Defendant Ibrahim A. denied the allegations, pointing to November 25, 2024, as the day of the incident, claiming he never left the security office that day. Ibrahim A. stated, "I have been working at the site for 3.5 years. On November 25, the complainant said she would go to the hospital and asked me to give the child the key. I handed over the key when the child returned from school. She came back saying she was scared, so I called her mother. I am being slandered. We had an argument during the move due to the air conditioning, and we had quite a dispute, but it did not warrant enmity from my side. I never went to their house."
The defendant also rejected claims that security camera footage had been deleted, stating, "It is impossible for the camera footage to be deleted; the system is motion-sensitive."
"SHE SAID, 'DON'T TELL YOUR MOTHER, DON'T TELL ANYONE'"
The victim child, who attended the hearing accompanied by a psychologist, detailed her experiences. The child stated that the defendant entered their home with her, had physical contact, and stayed in the house for nearly 45 minutes, saying: "At first, we only played in the elevator. The second time, before going home, he opened the apartment door and came inside with me. He picked me up and then threw me on the bed. He continued despite me saying 'Don't do it.' He stayed in the house for 45 minutes and said, 'Don't tell your mother, don't tell anyone.'
"I LEARNED ABOUT THE INCIDENT FROM MY DAUGHTER'S WORDS"
The victim's mother, Özlem D., stated in her testimony during the hearing that she learned the details of the incident by chance and reached the truth based on her daughter's accounts. Özlem D. said, "I don't know the exact date of the incident, but my daughter told me about it on December 7. When I told her that I have a herniated disc and shouldn't lift heavy things, she said, 'Mom, I can lift it for you; I can lift up to 60 kilos. I even lifted the site attendant.' After hearing these words, I became suspicious and called my friend. My daughter told my friend about the incident, and that's how I learned the truth. Based on my daughter's accounts, the times of phone calls, and the camera footage, we believe the incident occurred on December 2, 2024. The camera footage shows the defendant taking off his jacket and remaining in a short-sleeved black t-shirt. My daughter also said, 'He was wearing a black t-shirt.' Additionally, on November 25, I only asked him to give the key. We spoke on the phone twice that day, and my daughter did not mention anything about being scared. Since I would not be home on December 2 and 5, I put the key inside a shoe. We have serious indicators that the incident occurred on December 2."
WITNESSES CONFIRMED THE DEFENDANT
Two witnesses who claimed the defendant was in the security office on November 25 were also heard in court. The witnesses stated that the defendant did not leave the office that day. After hearing the witnesses, the prosecutor requested that the defendant be punished in his opinion. The victim's lawyer, Demet Burcu Ünal, also requested not only the punishment of the defendant but also his arrest.
10 YEARS IN PRISON
The court panel announced its decision at the first hearing. Defendant Ibrahim A. was sentenced to 10 years in prison for "qualified sexual abuse of a child under the age of twelve." The court stated that the right to appeal against the decision was open.
"A DECISION THAT WILL SET A PRECEDENT"
After the hearing, the victim's lawyer Demet Burcu Ünal stated that the decision made is an important example in child abuse cases, saying: "Although we went through a painful process, the defendant was sentenced to 10 years in prison at the end of the trial. We hope this decision will set a precedent in child abuse cases. The decision made in a single session has at least eased our hearts after a long and difficult investigation process."
"JUSTICE HAS BEEN SERVED"
Speaking after the decision, mother Özlem D. said that the sentence alleviated their pain, stating: "I did not expect this decision. We have been through a lot; it was a very difficult process. My daughter was very affected. But while I thought I would wait longer for this process, the fact that this decision was made at the first session relieved some of the pain we endured. Because this person is someone who should not be in society. This should not go unpunished; everything was already clear. My child explained everything clearly enough and even said things she could not know. May God be pleased with everyone; all the courthouse staff, our esteemed president, the associations, and the UCİM association. It was good news, a good decision. I couldn't hold back my tears in the hall; I am filled with joy. These were tears of happiness for the first time; justice has been served."
PRE-TRIAL COMPENSATION CRISIS
During the investigation process, the victim's mother, Özlem D., faced a lawsuit filed against her for allegedly assaulting the defendant and a demand for 70,000 TL in compensation. The mother reacted by saying, "His reputation was already gone before he abused my daughter."
After the statements of the victim, who was interviewed with a pedagogue at the Child Monitoring Center, the indictment prepared was accepted by the Antalya 3rd High Criminal Court, and the case was concluded today in the first session.
