The property regulation regarding 2B lands that have lost their forest status by the Ministry of Environment, Urbanization, and Climate Change primarily concerns citizens in Ankara, Aydın, İzmir, Manisa, Antalya, Samsun, Adana, and Mersin. With the intensive cadastral work to be carried out in these provinces, the process for citizens who have been using these areas for years to obtain title deeds will accelerate.
The Ministry of Environment, Urbanization and Climate Change will determine the property rights of citizens using approximately 100,000 hectares of 2B land that has lost its forest status and will issue their title deeds.
Minister Murat Kurum announced last week that the property rights of 2B lands will be determined and the title deeds will be delivered to the rightful owners. This work, which concerns approximately 5 million people, is aimed to be completed by the end of this year. WHAT IS 2B LAND?
- According to Article 2/B of the Forest Law No. 6831, lands that have completely lost their forest characteristics scientifically and technically before December 31, 1981 are being removed from forest status. Lands within this scope are considered as areas that are not forested and have been used by citizens for many years.
WHO DOES THE TITLE DEED PROCESS OF THESE LANDS COVER?
- It covers approximately 5 million people who have been using these lands that have lost their forest status and have been waiting for title deeds for years.
HOW ARE 2B LANDS REGISTERED?
- These lands, which are removed from forest boundaries by Forest Cadastre Commissions, are registered in the name of the Treasury.
Cadastre studies are carried out by the General Directorate of Land Registry and Cadastre, taking into account the actual usage status under the relevant article of the Cadastre Law No. 3402. In the declaration section of the cadastre report, if there are any structures (buildings, facilities, etc.) on it, it is stated to whom they belong and who has been using them for how long.
WILL THE IMPLEMENTATION HARM THE EXISTING FOREST ASSETS OR OPEN THE FORESTS TO CONSTRUCTION?
- It is absolutely out of the question for the work to cause such a situation. 2B lands are already considered as idle areas that have lost their forest status before 1981, covering an area of approximately 100,000 hectares, with defined boundaries and currently used by citizens.
WHAT SHOULD CITIZENS WHO WANT TO BENEFIT FROM THE REGULATION DO?
- After the usage cadastre studies are completed and the 2B lands are transferred from the General Directorate of Land Registry and Cadastre to the General Directorate of National Estate, citizens need to apply to the General Directorate of National Estate.
WHICH CITIES WILL BENEFIT THE MOST FROM THE REGULATION?
- Ankara, Aydın, İzmir, Manisa, Antalya, Samsun, Adana, and Mersin are among the cities where the 2B land usage cadastre studies will be conducted most intensively.
