Following the regulation that restricts hobby gardens and mandates the demolition of structures with demolition orders, a new bill in parliament introduces an absolute ban on establishing hobby gardens through cooperatives or opening agricultural land for construction. Municipalities that provide electricity and water subscriptions to unauthorized structures and facilities will face fines of 100,000 lira.
With the regulation published in the Official Gazette, structures such as hobby gardens, bungalows, and vineyard houses are now subject to inspection. The current issue on the agenda is the construction problem on agricultural lands through cooperatives.
BAN ON CONSTRUCTION THROUGH COOPERATIVES
According to the draft law amending the Soil Conservation and Land Use Law, which is expected to be discussed in the General Assembly of the Parliament next week, cooperatives will not be able to acquire property rights over immovables built on areas designated for agricultural protection in development plans. The only exception will be cooperatives engaged in agricultural activities. However, the acquisition of property rights by these cooperatives over such immovables will also be subject to the permission of the Ministry.
PENALTIES FOR BOTH LANDOWNER AND VIOLATOR
Determinations regarding agricultural lands will be made spontaneously by the governorates, without being dependent on any complaint. A fine of 2,500 Turkish lira per square meter will be imposed on degraded lands, and a period of 2 months will be given to demolish the structures and restore the land to its original state. This fine will be imposed separately on both the landowner and the person who degraded the land.
100 THOUSAND LIRA FINE FOR MUNICIPALITIES PROVIDING SUBSCRIPTIONS
Electricity, water, and natural gas connections and subscriptions will not be provided to any structure or facility built without permission. Public institutions acting contrary to this will be fined 100 thousand Turkish lira. Institutions fined must cancel the subscriptions within one month. For those where subscriptions continue, an additional fine of 100 thousand Turkish lira will be imposed for each month the subscription continues.
