With the new omnibus bill passed in the Turkish Grand National Assembly General Assembly, very strict rules are being implemented for candidate drivers. New drivers, who will be considered candidates for two years, will have their licenses directly revoked if they violate certain traffic rules such as alcohol or penalty points. To obtain a new license after revocation, they will need to meet challenging conditions such as undergoing a psychiatric examination and completing the driving course from the beginning.

During the Turkish Grand National Assembly General Assembly's discussions, the first 7 articles of the Draft Law on Amendments to Certain Laws and Decrees with the Force of Law were accepted, taking an important step towards enactment. In line with the Constitutional Court's previous annulment decision, this new amendment to the Highway Traffic Law increases the responsibilities of new drivers in traffic.

TWO-YEAR STRICT INSPECTION PERIOD

According to the adopted regulation; individuals obtaining a driver's license for the first time, as well as those whose licenses were revoked for any reason and who regain the right to obtain a new license, will be considered "provisional drivers" for two years from the date the license is issued. During this period, drivers will be subject to strict supervision with a much lower margin of error in traffic.

WHICH VIOLATIONS WILL LEAD TO LICENSE CANCELLATION?

Some critical errors made during the provisional driver period will result in the complete cancellation of the license, creating consequences that are difficult to remedy. According to the law, the main violations leading to license cancellation are as follows:

  • Committing a serious violation that requires the temporary withdrawal of the driver's license.
  • Exceeding the 75 penalty point limit by not complying with traffic rules.
  • Being detected driving with a blood alcohol level of 0.20 promille or above, regardless of the vehicle type.
  • Violating any of the provisions regarding turning rules, giving priority to pedestrians, and the mandatory use of protective systems (seat belts, helmets, etc.) three times.

WHAT ARE THE STRINGENT CONDITIONS FOR REISSUING A LICENSE?

Those whose provisional driver's licenses are canceled due to non-compliance with the rules must complete a challenging process from scratch to get back behind the wheel. The cancellation will be carried out by traffic police, and these individuals will be required to first undergo a psychotechnical evaluation and examination by a psychiatrist to obtain a health certificate showing that they have "no obstacle to driving."

Those who successfully pass these health examinations will be able to register for driving courses from scratch after paying all imposed administrative fines and completing any waiting periods (or temporary suspension periods). Candidates will be required to attend course training without interruption, pass the exams again, and obtain a motor vehicle driver's certificate.
