The 12-article framework law proposal aimed at establishing the legal basis for the Türkiye without Terrorism process has passed through the Turkish Grand National Assembly (TBMM) Justice Commission. The regulation, which provides for postponements of trials and executions, a ban on politics, the exclusion of certain crimes from the scope, and the establishment of new boards for the supervision of the process, will be discussed today in the General Assembly of the Parliament. If approved by the General Assembly, the law proposal will become law.
Turkey is preparing for a milestone today. The 'Terror-Free Turkey' process, which began approximately two years ago with the call of MHP Chairman Devlet Bahçeli and the initiatives of President Recep Tayyip Erdoğan, is nearing its end.
ACCEPTED IN COMMISSION AFTER 18-HOUR MEETING
The Law Proposal on Strengthening National Solidarity and Social Cohesion, prepared for the Terror-Free Turkey process and submitted to the Presidency of the Grand National Assembly of Turkey (TBMM) on Wednesday, August 5, with the signatures of 360 deputies, was accepted in the TBMM Justice Commission on August 8 after an 18-hour meeting and sent to the General Assembly of the Parliament.
All eyes are now on the TBMM General Assembly where the proposal will be discussed. The regulation will be taken up in the General Assembly today.
WHAT DOES THE LAW PROPOSAL INCLUDE?
The proposal, which aims to put the Terror-Free Turkey process on a legal basis, consists of a total of 12 articles. The regulation covers establishing or managing the PKK/KCK, being a member of the organization, aiding the organization, organization propaganda, and crimes committed within the scope of the organization's activities.
UNDER WHICH CONDITIONS WILL IT BE APPLIED?
The regulation will be applied if the conditions regarding the organization's disarmament and dissolution process are fulfilled. As a precondition in the proposal, the National Security Council's (MGK) decision on the dissolution of the terrorist organization must be published in the Official Gazette. After this stage is completed, the provisions stipulated in the law will begin to be implemented.
HOW MANY MONTHS WILL THE LAW BE IN EFFECT?
After the MGK's decision on the dissolution of the terrorist organization is published in the Official Gazette, a 6-month period will begin for those who wish to benefit from the regulation. It is envisaged that those who wish to benefit from the regulation must take advantage of the relevant provisions within this period.
TRIALS WILL BE POSTPONED
According to the framework law proposal, different postponement periods will be applied in trials, depending on the prison sentence required by the crime. For crimes requiring imprisonment of 15 years or less, trials will be postponed for 5 years, and individuals will be subject to supervision during this period. For crimes requiring imprisonment of more than 15 years, it is envisaged that trials will be postponed for 10 years. Individuals will also be subject to supervision during this period.
POSTPONEMENTS IN PENAL EXECUTIONS
The proposal also includes postponement provisions for individuals with finalized prison sentences. Accordingly, in the execution of sentences, 5 and 10-year postponement periods will be applied depending on the amount of the sentence.
If a 'terror crime' is committed again during the postponement period, the postponement decision will be lifted, and both the previously imposed sentence and the sentences arising from the newly committed crime will be executed together.
THERE WILL ALSO BE A POLITICAL BAN
There is also a provision regarding political rights for individuals benefiting from the regulation. According to the proposal, a political ban of 2 to 3 years will be applied to individuals who will benefit from the regulation.
CRIMES EXCLUDED FROM THE SCOPE
The proposal leaves some serious crimes committed within the scope of the organization's activities outside the regulation.
Accordingly, the crime of premeditated murder committed within the scope of the organization's activities, and crimes committed before June 1, 2005, requiring life imprisonment or aggravated life imprisonment, will not be included in the scope of the regulation.
ÖCALAN WILL NOT BE ABLE TO BENEFIT FROM THE REGULATION
Due to the provisions regarding crimes excluded from the scope in the proposal, it is stated that the PKK terrorist organization leader Abdullah Öcalan will not be able to benefit from the said regulation.
In this respect, the regulation also includes limits regarding the PKK's executive cadres.
A SUPERVISORY BOARD WILL BE ESTABLISHED
The proposal includes not only judicial and execution provisions but also new mechanisms for tracking and supervising the process.
A board will be established under the chairmanship of Vice President Cevdet Yılmaz to ensure the tracking, supervision, and coordination of the process.
A MONITORING COMMISSION WITH 17 MEMBERS WILL BE ESTABLISHED
The regulation envisages the establishment of a separate structure within the TBMM to follow the process.
17 members will serve on the monitoring commission to be established in the Parliament. The commission will undertake the task of monitoring the process to be carried out within the scope of the law.
CRIMINAL LIABILITY REGULATION FOR PUBLIC OFFICIALS
The proposal also includes a provision regarding public officials who will take part in the execution of the process. It is envisaged that public officials operating within the scope of the law will not have criminal liability for the transactions they carry out.
The process for the 12-article proposal, accepted after the 18-hour meetings in the Justice Commission, will now continue in the TBMM General Assembly.
