The indictment states that the hotel owners, board members, and managers Halit Ergül, Emine Murtezaoğlu Ergül, Ceyda Hacıbekiroğlu, Elif Aras, Emir Aras, Zeki Yılmaz, Ahmet Demir, Kadir Özdemir, Cemal Özer, Mehmet Salun, as well as Bolu Municipality Deputy Mayor Sedat Gülener, Acting Fire Chief Kenan Coşkun, and Firefighter İrfan Acar are "responsible for the incident with possible intent."

"THE FIRE STARTED FROM THE 'GRILL PLATE' DEVICE" According to the indictment, on the night of the incident, the hotel's breakfast chef Faysal Yaver turned on the electric grill called "grill plate" in the restaurant located on the fourth floor of the hotel. It was determined that the device, which remained on until the moment the fire started, did not function due to excessive corrosion of the thermostat in the middle of its 3 thermostats, and as a result, overheating occurred in the device.
"THE SHORT CIRCUIT IN THE DEVICE STARTED THE FIRE" Due to the heating in the device, a short circuit occurred due to wear and aging effects on the grill conductors. After the short circuit could not be eliminated by the circuit breaker protective elements, the fire started at 03:17 with a small flash from the "grill plate" device, referred to as "showroom," due to the evaporation and burning of animal fats in the grill section of the device.
"FLAMES SPREADING TO THE HOSE SUPPLYING LPG INCREASED THE FIRE" The fire spread from the "grill plate" compartment to the nearby trash can and then to the hose supplying LPG at 03:24. As the flames melted the hose and ignited the LPG gas, the fire accelerated excessively, exceeding "controllable limits" at 03:26, and the color of the flames began to turn blue. Subsequently, the varnished OSB and wooden decorations used on the ceiling rapidly vaporized, causing excessive smoke and rapid burning.
"THERE WAS NO GAS EXHAUST SYSTEM IN THE HOTEL" The structure of the materials in the area where the fire first started and the fact that the kitchen staff left the door leading to the closed parking lot open for escape also accelerated the burning. Additionally, the inadequacy and faults in the stair and elevator structures, and the absence of a gas exhaust system caused flammable and toxic gases to rise rapidly to the upper floors of the hotel, filling all corridors with toxic smoke and flammable gases.
The "wooden paneling and coverings" among the structural elements of the building were also affected by the high temperatures and heat generated by the fire, while the window glasses exploded due to the sudden increase in ambient temperature, carrying the gases outside the building. This incident ignited the wooden cladding material on the exterior of the building, causing the flames to rise on the facade.
"THE HOTEL'S EMERGENCY ACTION PLAN IS INSUFFICIENT" "Although the fire issue was identified among emergencies for the hotel, the emergency action plan prepared was insufficient, the fire team and first aid team determined in the disaster management plan were composed of inadequate, inexperienced, and untrained individuals, the content of the emergency action plan was also insufficient, and due to the lack of fire training for the staff in the hotel, the staff did not know what to do, instead, they opened the main parking doors, which accelerated the fire, and there was no audible or visual automatic warning reaching the reception officer during the fire growth phase, thus the assigned personnel could not intervene in the fire and inadvertently engaged in behaviors that would accelerate the fire."
The indictment states that on the night of the fire, four staff members were working in the hotel kitchen to prepare breakfast, that the fire was first noticed at 03:24, that the staff member who noticed it informed the other staff, and then left the kitchen area. It was noted that the gendarmerie was called at 03:26 and the 112 Emergency Call Center was called on 03:27.
