The AK Party is completing preparations in the Parliament for a new regulation that will end the indefinite alimony practice; the planned regulation aims to impose limits on alimony based on the duration of marriage and to provide social support for those affected.
A new step is being taken for the alimony issue, which has been a topic of discussion in Turkey for many years. The AK Party, drawing attention to the fact that there are thousands of people who continue to pay alimony despite years passing since the divorce, is preparing a comprehensive regulation to address the grievances caused by the indefinite alimony application...
REGULATION TO BE PRESENTED TO THE GRAND NATIONAL ASSEMBLY
It has been learned that the work of the AK Party officials is nearing completion, and the prepared regulation will be presented to the Grand National Assembly of Turkey in a short time. The main goal of the study is stated to be reducing the social and economic problems created by the prolonged divorce cases and indefinite alimony between the parties.
TIME LIMIT FOR ALIMONY IS COMING
According to the prepared draft, the duration of marriage will be taken as the basis for the alimony application. Accordingly;
- Those who have been married for 3 years will receive alimony for 5 years,
- Those who have been married for 5 years will receive alimony for 7 years,
- Those who have been married for 10 years will receive alimony for 12 years.
At the end of this period, the alimony obligation will cease.
SOCIAL SUPPORT FOR GRIEVANCES
The activation of social assistance mechanisms for women who may experience financial difficulties with the termination of alimony is also among the important topics of the regulation. Thus, it is aimed to address the grievances that may arise when alimony is cut with state support.
NEW STEPS FOR DIVORCE CASES
Reducing contentious divorce cases is also among the goals of the regulation. It is planned to address the factors that cause the prolongation of cases separately and to conclude the process more quickly. It is emphasized that paying alimony for many years in short-term marriages creates a serious environment of hatred and conflict between the parties.
EXPERT OPINIONS WILL BE SOUGHT
While preparing the regulation, it was stated that the opinions of academics and non-governmental organizations will also be taken, and the final shape of the draft will be given in line with these opinions. The study is expected to be presented to the Parliament as part of a comprehensive reform package related to Family Law.
ERDOĞAN HAD ALSO SIGNALLED REFORM
President Recep Tayyip Erdoğan had previously announced in his statements that new reforms in family law were on the way. Erdoğan had stated that significant changes were planned in the structure of family courts, especially regarding divorce and alimony processes.
