The fake heirs of Arab Süleyman and Hacı Bekirzade Mehmet Ağa, two main heirs of billions of dollars worth of land in Antalya, have been affecting the lawsuit that has been ongoing for about 70 years. One of the lawyers of the case, Necati Yılmaz, said, "Anyone who finds the name 'Süleyman' in their family comes to this case."
In the city, there is a 67-year-old lawsuit regarding lands registered in the name of Arab Suleyman, Hacı Bekirzade Mehmet Ağa, and the Treasury, worth billions of dollars, where issues of fake heirs and their intervention in the lawsuits are being experienced.
THE INHERITANCE CONCERNING LAND IS EXACTLY 2 MILLION 400 THOUSAND SQUARE METERS
In this area of 2 million 400 thousand square meters; there are the Tourism Application Hotel, Antalya Training and Research Hospital, Falez and Rixos hotels, Glass Pyramid Park, AKM, Atatürk Cultural Park, Glass Pyramid Fair and Congress Center, Antalya Tennis Specialization Club, fuel station, Antalyaspor Facilities, Corendon Stadium, Antalya Courthouse, Antalya Sports Hall, around 10 thousand residences in countless sites, Meltem Market, facilities, schools, parks, Land Registry Regional Directorate, mosques, parking lots, cooperatives, and many more structures.
"THEY HAVE NO IDEA HOW THEY BECAME HEIRS"
Lawyer Necati Yılmaz, who has been following the case on behalf of some heirs of Hacı Bekirzade Mehmet Ağa and Arab Suleyman for over 20 years, pointed out that there are hundreds of people who appear to be parties in this file. Yılmaz stated, "They say 'We are the heirs of Arab Suleyman,' but they have no idea how they became heirs. Anyone who finds the name 'Suleyman' in their family comes to this file. The courts also have a fault. Without any examination, without fulfilling the procedural requirements related to this, they decided to accept the requests for original intervention regarding these demands. A lot of people appear as original interveners in the file, but they don't even know how they became heirs," he said.
REQUEST OF A PERSON WHO IS NOT A 'PARTY'
Necati Yılmaz noted that the latest request of a person claiming to be an heir of Hacı Bekirzade Mehmet Ağa was rejected, stating, "Actually, he is not yet a party in the case. In other words, it is not possible for him to make a request without a decision being made regarding his intervention request, that is, without gaining the status of a 'party.' The court mistakenly made such a decision. That is, despite there being no need for a decision to be made, they decided to reject it. They have used this and the file is back at the Regional Court of Appeal. However, the Regional Court of Appeal had already made a decision three months ago. What is the point of sending the same decision there again? The aim here is to keep the file in limbo somehow. Various people are trying to take advantage of this," he expressed.
"THEY CLAIM THERE WERE CHILDREN BORN BEFORE THEIR MOTHER"
Yılmaz cited H.Y., who intervened in the case with claims that she is the heir of Arab Suleyman's daughter Hava and is being tried for forgery of documents, as an example, saying, "The person called H.Y. came at the time and made requests in exchange for withdrawing these lawsuits. However, of course, it is not just about H.Y. withdrawing her request. There are hundreds of people. There is a group of people. For example, there are those who claim to be the heirs of Zeynep, the granddaughter of Suleyman Ağa. Zeynep's birth date is 1877. The birth date of the daughter, that is, the person they claim to be her son or daughter, is 1872. They claim that there are children born before their mother. These are such ridiculous situations. However, the courts are accepting intervention requests without sufficient examination," he said.
THE MORE PARTIES, THE MORE DIFFICULT
Necati Yılmaz stated that the addition of such individuals as interveners complicates the case, and continued:
"The more parties there are, the more difficult it becomes. Everyone has a right to appeal. There are rights of appeal for many people, both related and unrelated. You are giving these rights unlawfully. Therefore, the file is delayed for this reason. Many people die between two hearings. Their participation in the lawsuits is necessary. The court is trying to include the inheritance certificates of people whose heir status we do not know, along with their children, in the case. These are situations that leave these lawsuits in limbo."
BAGS FULL OF DOCUMENTS
Due to the name 'Süleyman,' the heirs of 'Süleyman Ağa' mentioned in a similar incident in the Serik district have also caused confusion in this case, resulting in bags full of documents over 67 years. Lawyer Necati Yılmaz, who has been representing this case for a long time, also stated that bags full of documents have been created regarding this case and the lawsuits opened in this context since 1958.
