The defendant, who was on trial for allegedly threatening his child with a knife during a video call with his spouse, who is in the process of divorce in Izmir, was released under judicial control with the condition of "house arrest."
A decision has been made for the father who was tried for threatening his estranged wife with a knife to her child's throat during a video call in İzmir.
In the hearing at the İzmir 18th High Criminal Court, the complainant F.C. participated via the Audio and Visual Information System (SEGBİS), while the detained defendant Ş.A. and the lawyers of both parties were also present in the courtroom.
In the first hearing held after the case was sent to the high criminal court, Ş.A. claimed that the reason for the events reaching this stage was F.C., whom he was married to at the time.
"I DEFINITELY DID NOT PUT THE KNIFE TO HIS THROAT"
Ş.A., who alleged that F.C. had cheated on him and constantly hid her phone from him, stated, "She was threatening me with the man she was running away with and putting psychological pressure on me. She said, 'I don't want the children you have with me.' I went to the police station several times. I regret it; this incident keeps coming to my mind. I worked day and night to take care of my wife and children. She sent me a photo with the man she was with. In a moment of anger, I don't know what I did; I definitely did not put the knife to his throat," he said.
When asked about the contradictions in his previous statements, Ş.A. said, "In a moment of anger, I wanted to kill myself and my children." The defendant's lawyer stated that his client officially divorced the previous week.
"HE PUT A KNIFE TO MY THROAT TOO"
The complainant F.C. stated that she was constantly subjected to violence and used the following statements:
"When I wanted to separate, he did not consent. He put a knife to my throat too; I escaped from him. He was telling people around him that he would kill the children. I had a confidentiality order issued and rented a new house for myself. Later, I went to the bank, and he sent a message saying, 'open the emergency phone.' When I opened the video call, he placed the phone in front of Berat. He said, 'I will cut the child's throat; watch it live.' After recording, I ended the call, called the police, and filed a complaint."
The court panel decided to release Ş.A. under judicial control measures in the form of "house arrest" and postponed the hearing.
WHAT HAPPENED?
F.C. (26), who was in Burdur, applied to the prosecutor's office with a complaint that Ş.A. (32), who was living in İzmir and was in the process of divorce at that time, threatened her by putting a knife to her child's throat during a video call. Following the complaint, Ş.A. was detained by police teams on November 18, 2024, and was arrested.
It was announced that the children present with the father were placed under the protection of the Provincial Directorate of Family and Social Services.
An indictment prepared by the İzmir Chief Public Prosecutor's Office against Ş.A. sought a total of 8.5 years in prison for "intentional injury" and "threat with a weapon" against the child B.A., and for "threat with a weapon" against his wife, with a maximum of 2 years. The indictment was accepted by the İzmir 29th Criminal Court of First Instance.
The defendant, who was released in the first hearing, was re-arrested after the İzmir Chief Public Prosecutor's Office appealed the release decision. Later, the İzmir 29th Criminal Court of First Instance issued a "lack of jurisdiction" decision and sent the case to the high criminal court.
The İzmir 18th High Criminal Court determined that the crime of "threat" had occurred in the incident and ruled that the prosecution duty belonged to the criminal court of first instance.
With both courts issuing a "lack of jurisdiction," the case was sent to the İzmir Regional Court of Appeal, where the 23rd Criminal Chamber decided that the charges against the defendant were within the jurisdiction of the high criminal court and overturned the lack of jurisdiction decision of the İzmir 18th High Criminal Court, ruling that the defendant should be tried for "attempted murder."
