AK Party Group Chairman Abdullah Güler stated that the regulation aimed at preventing exorbitant increases in site fees has been presented to the Parliament. Güler said, "We are implementing the decision quorum as 2 out of 3 instead of 4 out of 5 by leaving the authority to increase fees to the homeowners' assembly. And we definitely recommend that the increase in fees should be left to the homeowners' general assembly."

REGULATION FOR SITE MANAGEMENTS

Güler used the following statements regarding the regulation: "Especially in recent times, we desire to implement some regulations in response to complaints about high fees that are outside the decisions made by site managements or property owners. With the amendments made to the property ownership law, we aim to put an end to arbitrariness or unjust demands experienced in site and apartment managements. By leaving the authority to increase fees to the property owners' assembly, we are applying the decision quorum as 3 out of 2 instead of 5 out of 4, taking into account the difficulties experienced in changing management plans, especially in large complexes with a high number of owners. And we definitely recommend that the issues of fee increases be left to the general assembly of property owners."

MEETING OF PROPERTY OWNERS' ASSEMBLY WILL BE MANDATORY

The regulation also foresees a new process regarding the finalization of the new fee amount. Accordingly, it will become mandatory for the property owners' assembly to meet within a maximum of 3 months to determine the fee increase.

A majority of 50%+1 will be required to make a decision at the meeting. If this majority cannot be achieved, a decision can be made by the majority of those present at the second meeting.

THERE WAS NO LIMITATION IN THE CURRENT PRACTICE

Currently, although the authority to collect fees in sites lies with the board of directors, there was no upper limit regarding the determination of the fee amount. After the determined fee amount is communicated to the site residents, if no written objection is made within 7 days, the new amount becomes final.

STRICT MONITORING OF SITE MANAGEMENT COMPANIES

The new regulation covers not only fee increases but also the operations of site management companies. Accordingly, management companies will be placed under strict supervision, and their business processes will be redefined.

Companies will be certified and registered according to their capacities. Additionally, representatives, facility managers, and auditors will be required to participate in periodic training.

It is planned that the auditors authorized by the Ministry will inspect the companies and the services they provide at least once a year.
