COUNCIL OF STATE'S DECISION ON KARTALKAYA



A new development has occurred in the investigation regarding the tragedy that took place at the Grand Kartal Hotel in Kartalkaya, Bolu, on January 21, 2025, where 78 people lost their lives. The Council of State granted permission for an investigation for 9 individuals from the Ministry of Culture and Tourism.



INVESTIGATION PERMISSION FOR 9 MINISTRY PERSONNEL



Abdurrahman Gençbay, the President of the 9th Chamber of the Council of State, who lost his son Yiğit Gençbay in the fire, and Eray Mercan, who lost his son Alp Mercan in the same incident, presented the findings of the Bolu Chief Public Prosecutor's Office, stating that "one of the responsible parties in the incident is also the Ministry of Culture and Tourism." In their application, they expressed that "the Ministry of Culture and Tourism's decision to grant investigation permission only to inspectors prevents the public harm and service deficiencies from being revealed in all aspects," and requested that investigation permission be granted for all public officials of the Ministry of Culture and Tourism who were negligent.



NO INVESTIGATION PERMISSION GRANTED FOR DEPUTY MINISTER



The Council of State's 1st Chamber definitively resolved the objections made against the decision of "not granting investigation permission." The Council of State's 1st Chamber granted investigation permission for General Directors of Investment and Enterprises Neşe Çıldık and Şennur Aldemir Doğan, Deputy General Directors of Investment and Enterprises Bülent Çınar Çavuş and Elçin Şimşek, Deputy Chairman of the Board of Inspectors Levent Kırcan, Chief Inspectors Ramazan Alkan, Melda Araz, Şule Aktürk Alkan, and Barış Başayvaz. However, no investigation permission was granted for Deputy Minister of Culture and Tourism Nadir Alpaslan and two intern students. The Chamber made its decision unanimously regarding some names and by majority vote regarding others.



A member of the Council of State's 1st Chamber voted against the request for investigation permission for Deputy General Directors of Investment and Enterprises Bülent Çınar Çavuş and Elçin Şimşek, stating that "there were no inspection, oversight, and control duties at the Grand Kartal Hotel, and in the event of any irregularities being detected during the inspection at the hotel, there were no instructions or guidance to overlook or cover them up."



The President of the Council of State's 1st Chamber noted that "Ramazan Alkan, Melda Araz, Şule Aktürk Alkan, and Barış Başayvaz acted in accordance with the legislation," and stated that the objections against the refusal to grant investigation permission should be rejected.
