Discussions have begun in the Turkish Grand National Assembly General Assembly on the 12-article framework bill prepared to establish the legal infrastructure for the Terror-Free Turkey process. While the AK Party, MHP, DEM Party, CHP, and New Path Party stand behind the proposal, the İYİ Party opposes it. The Felicity Party has announced conditional support for the proposal, while the New Welfare Party is expected to vote 'abstain'. New Party Chairman Özgür Özel has announced he will vote 'yes' on the bill.
The bill known publicly as the 'framework law,' the Proposal for the Law on Strengthening National Solidarity and Social Cohesion, came onto the agenda of the Grand National Assembly of Turkey (TBMM) General Assembly today. The 12-article proposal, which was accepted after 18 hours of discussions in the Justice Commission, has also largely clarified the attitudes of political parties at the General Assembly stage.
FULL SUPPORT FROM AK PARTY, MHP, AND DEM PARTY The proposal receives full support from the People's Alliance partners AK Party and MHP, as well as DEM Party. Members of parliament from these parties are expected to vote 'yes' in the General Assembly vote.
ABDULHAMİT GÜL: IMPERIALISTS' EFFORT TO BREAK OUR BROTHERHOOD WILL BE THROWN INTO THE DUSTBIN OF HISTORY In his speech at the General Assembly, AK Party Deputy Group Chairman Abdulhamit Gül reminded that today marks the anniversary of President Recep Tayyip Erdogan's direct election by the people, stating that President Erdogan, with the authority and power he received from the nation, stands by the people both in regional and global crises and for the peace and prosperity of the country.
Reminding that today is also the anniversary of the Anafartalar Victory, Gül continued his words as follows: "When we say 'August 10' today, we remember the Çanakkale epic on the 111th anniversary of the Anafartalar Victory. It is a historical day when we witnessed how brave men from Diyarbakır, Ağrı, Kars, İzmir, and Trabzon stood shoulder to shoulder and became martyrs for this noble nation, and established a Republic and a state for this noble nation. Therefore, we commemorate with mercy foremost the Anafartalar Commander Gazi Mustafa Kemal Atatürk and his comrades in arms, and all our martyrs. Today, they say it's the anniversary of 'Sevres' and here we are. The day that is meaningful for us is the Anafartalar epic, where a legend was written at Çanakkale, and the spirit of Çanakkale. "
Pointing out that Sevres was a project of the imperialists, Gül assessed, "With Sykes-Picot, it was a game set up by the imperialists to stir up these issues in the region and weaken Turkey. The Gazi Assembly took that piece of paper and tore it up. BAHÇELİ APPLAUDS BAKIRHAN'S SPEECH DEM Party Co-Chair Tuncer Bakırhan, regarding the 'framework law' proposal, said, "A century-old Kurdish issue is moving from the shadow of conflict to the ground of law. This process will offer a great opportunity not for the division of Turkey but for its integration, not for separation but for strengthening common life." MHP Chairman Devlet Bahçeli applauded Bakırhan's speech.
"THE HOMELAND IS SHARED, THE FUTURE IS SHARED" Stating that peace is not a competition, Bakırhan addressed Turkish citizens, saying, "There is nothing missing from you in this process, and there won't be. On the contrary, this is a process that will grow Turkey and bring it prosperity. The integrity and values of the country are never a subject of negotiation. If Kurds wanted to separate, we wouldn't be under the roof of this Assembly together with our friends. We are here because the homeland is shared, and the future is shared."
Also addressing the Kurdish people, Tuncer Bakırhan said that the process is not about erasing identity but about connecting existence with law. Bakırhan, stating that they know the concern of "Will we be deceived again," said, "First of all, Kurds are an organized people; they neither bleed nor are deceived. And even if our scale falters, there is a balance to fix it, and that is you."
"FIRE IS NOT EXTINGUISHED WITH FIRE" Stating that they will continue to struggle for the democratic rights of the Kurdish people in the political arena, Bakırhan said, "But now there is a fire that burns us all, we must first extinguish that fire. In Kurdish, it is said that fire is not extinguished with fire. Believe me, this is the simplest truth that 50 years of conflict has taught us."
CHP, NEW PATH, AND HÜDA PAR WILL ALSO SAY "YES" CHP, which was among the parties that signed during the preparation process of the proposal, also announced that it will support the regulation at the General Assembly. CHP Deputy Group Chairman Rahmi Aşkın Türeli stated, "We will support the Proposal for the Law on Strengthening National Solidarity and Social Cohesion, with the thought that with the permanent end of terrorism, the removal of weapons from play, and the strengthening of democratic politics, a new era in which our Republic is crowned with democracy will begin."
The New Path Party will also vote in favor of the adoption of the proposal. Speaking before the General Assembly, New Path Deputy Group Chairman Bülent Kaya expressed his wish for the process to succeed, and said that after the weapons are laid down, Turkey should also progress in the fields of law, democracy, and economic development.
New Path Party Deputy Group Chairman Bülent Kaya thanked President Recep Tayyip Erdogan, MHP Chairman Devlet Bahçeli, Felicity Party Chairman Mahmut Arıkan, and the leaders of political parties for their contributions to the Terror-Free Turkey process. Wishing for the success of the process, Kaya said, "We believe that there is a very long and arduous road ahead, and that this long and arduous road can be overcome not with political polarization and divisions, but on the contrary, by building a democratic political order, and I extend my thanks and respect once again to everyone who contributes to the process."
HÜDA PAR is also among the parties that will vote 'yes' for the proposal.
CONDITIONAL SUPPORT FROM THE FELICITY PARTY Felicity Party Chairman Mahmut Arıkan, stating that they give 'conditional support' to the framework law proposal, said, "The issue is not just the liquidation of a terrorist organization, but the complete elimination of the ground that reproduces terrorism. The methods and procedures for the complete abandonment of arms, the liquidation of the terrorist organization, whether Turkey's unity and integrity will be opened to debate, the continuity of the TBMM's status as the center of the solution, and how it will be possible to reintegrate people who have not been involved in violence into society are shaping up around these issues."
İYİ PARTY IS DEFINITELY AGAINST The fiercest opposition to the proposal came from the İYİ Party. İYİ Party Deputy Group Chairman Turhan Çömez criticized the preparation and commission process of the proposal in his speech at the General Assembly. Çömez, who argued that the amendment is unconstitutional, said the proposal should not be accepted.
Çömez stated that Turkey should be free of terror and terrorists. Expressing that he condemns those who stand behind terrorism and those who cannot distance themselves from it, Çömez argued that the concept of "peace" is being exploited by certain segments. Criticizing the fact that the Draft Law on Strengthening National Solidarity and Social Cohesion was sought to be discussed on August 10, the date the Treaty of Sèvres was signed, Çömez said, "As the İYİ Party, we have done our best to ensure an atmosphere where everyone can live in friendship and brotherhood in this beautiful country, and we will continue to do so from now on."
MÜSAVAT DERVİŞOĞLU: WE WILL STAY TRUE TO OUR OATH, WE WILL SAY NO Speaking at the General Assembly, İYİ Party Leader Müsavat Dervişoğlu said: "Today, I state once again from this podium. This government is using the authority it holds not like a construction permit, but like a renovation permit that corrodes the state from within. The nation has indeed seen very well what has been done throughout this process. From the very first day, we have explained to the Turkish nation on every occasion what the domestic and foreign intentions behind the weeks-long mediator game, fancy words, big talk, and dirty propaganda are, and what has been happening.
Now, has this law proposal been prepared by the Grand National Assembly of Türkiye that it is being submitted for its approval? The Assembly has been reduced to merely a registration authority, as at the beginning of the process. The seal of judgment of the Turkish nation has been forcibly used without its knowledge and consent.
While this law provision was passing through the approval of the terrorist convict on İmralı, it was hidden from the Turkish Nation. Has this law proposal been prepared by the TBMM that it should be submitted for its approval? We will stay true to our oath, we will say no."
YENİDEN REFAH "HESITANT" The New Welfare Party is also among the parties that will not support the Framework Law. Deputy Chairman Suat Kılıç had announced that his party believes the law proposal should be taken to a referendum. Chairman Fatih Erbakan also stated, "Due to the uncertainties regarding the subsequent steps involved in the process, we submit to our noble nation that as the New Welfare Party, we will vote 'abstain' on the 'framework law'."
DEPUTIES FREE IN NEW PARTY The New Party, which all eyes are on, did not make a decision as a group to vote "yes" or "no." Following the closed group meeting of the New Party, it was decided that deputies would vote according to their own will.
ÖZGÜR ÖZEL: OUR DEPUTIES WILL DECIDE ACCORDING TO WHAT THE NATION SAYS IN THEIR PROVINCES New Party Chairman Özgür Özel, who explained his party's stance in his speech at the General Assembly, said, "With this understanding, trusting not the government but our nation, trusting not this text but our party's stance and the stance our deputies will show, without vouching for this text but carrying the responsibility of peace, standing against the government's account but undertaking a responsibility that will open the way for Türkiye's future. I and my fellow executives, with historical consistency and responsibility, will say 'yes' to this law. Along with this, I declare to all our citizens that our New Party was founded by the nation. The nation named our party. It is our nation that has grown and strengthened the party. Therefore, our deputies will decide and vote according to what the nation says in the provinces where they were elected. With this statement, I am not leaving the New Party Group free in its decision. On the contrary, I am leaving them alone with the responsibility of being the nation's deputies, taking into account the sensitivities, expectations, concerns, hopes, and excitement of their own provinces, regions, and the social segments they represent. No New Party deputy will act without hearing the voice of their members and the nation; this is the requirement of the New Party's new-generation politics."
HOW LONG WILL THE DISCUSSIONS LAST? If the deliberations on the law proposal are not completed, the General Assembly may work until Thursday, after which the Parliament will take a break until October 1.
367 DEPUTIES SIGNED On the other hand; the proposal, bearing the signatures of 367 deputies including AK Party, MHP, DEM Party, CHP, HÜDA PAR, and some independents, consists of 12 articles.
HERE ARE THE DETAILS OF THE REGULATION The precondition of the law is that security institutions determine and confirm that the organization's existence has been ended and all its weapons have been surrendered, and that the National Security Council's decision regarding the dissolution of the terrorist organization is published in the Official Gazette. When this happens, a 6-month period will be granted to benefit from the regulation.
The proposal covers the crimes of establishing or managing the PKK/KCK terrorist organization, being a member of the organization, knowingly and willingly aiding it, making propaganda for the organization, crimes committed within the scope of the organization's activities, and crimes regulated in the Law on the Prevention of Financing of Terrorism committed in favor of the organization.
Provided that security institutions determine that the organization has ended its actual existence and surrendered all weapons and ammunition under its control, and that the National Security Council Decision confirming this determination is published in the Official Gazette, except for those convicted of intentional homicide committed within the framework of organization activities and those sentenced to life imprisonment or aggravated life imprisonment for crimes committed before June 1, 2005, the execution of sentences of convicts sentenced to a total of 15 years or less imprisonment for crimes falling within the scope of the regulation will be postponed for 5 years, and the execution of sentences of convicts sentenced to more than 15 years in total, life imprisonment, or aggravated life imprisonment will be postponed for 10 years, by the decision of the execution judge.
MATERIALS BROUGHT BY ORGANIZATION MEMBERS WILL BE RECORDED The monitoring and evaluation of the implementation of the activities within the scope of the proposal will be carried out, following the publication of the regulation in the Official Gazette, by a Board chaired by the Vice President and composed of the Minister of Justice, Minister of Foreign Affairs, Minister of Interior, Minister of National Defense, Secretary General of the Presidency, Head of the National Intelligence Organization, and Secretary General of the National Security Council.
