The trial of singer Fatih Karacan, known as Mabel Matiz, continued on charges of 'facilitating the publication of obscene publications,' with demands for a prison sentence of 6 months to 3 years, based on claims that the lyrics of his song 'Perperişan' contained obscene depictions and that the work was distributed on digital platforms without age restrictions.
LAWYER MADE A DEFENSE
Mabel Matiz did not attend the hearing held at the Istanbul 54th Criminal Court of First Instance, but his lawyers were present in the courtroom. Making a defense against the opinion on the merits, his lawyer said, 'It seems unrealistic that those who are not bothered by songs played at weddings in villages today are disturbed by just one sentence in my client's song.'

The court, in its verdict hearing, ruled for Karaca's acquittal on the grounds that the legal elements of the crime were not present.

The indictment stated that the lyrics of the song 'Perperişan' indirectly incited sexual desire, created erotic connotations through bodily or spiritual metaphors, and included depictions that could easily be understood by everyone as referring to sexual intercourse. It was emphasized that the song was publicly published on social media and digital platforms with Matiz's consent and approval, and that no age restrictions were applied to the publications. The indictment noted that the song posed a danger to public order and the protection of children for this reason, and that its publication on platforms accessible to children led to the qualification of the crime attributed to Matiz. It was highlighted in the indictment that Matiz, in his statement, did not accept the accusation and stated that he used the line 'Diyo şeytan üstüne atla da sal kuşu hanesine' to mean sending a message to the home of a loved one, but considering the entire song and especially the meaning integrity of these two sentences, it was stated that this did not match the suspect's defense. The prosecutor's office demanded that Fatih Karaca, known by the pseudonym 'Mabel Matiz,' be sentenced to 6 months to 3 years in prison for the crime of 'facilitating the publication of obscene publications.'
