In the case filed regarding the annulment of CHP's 2023 congress, the "precautionary injunction" detail in the court's "absolute nullity" decision drew attention. Accordingly, since a precautionary injunction was granted, Özgür Özel and his administration's term has ended, and former Chairman Kemal Kılıçdaroğlu is expected to return to the chairmanship.
In the case filed for the annulment of CHP's 38th Ordinary Congress and 21st Extraordinary Congress, the 36th Civil Chamber of the Ankara Regional Court of Appeal issued a 'absolute nullity' decision regarding both congresses. Following the absolute nullity decision, the Central Executive Board of CHP held an extraordinary meeting.
THE COURT DECIDED TO IMPLEMENT A PRELIMINARY INJUNCTION
The court ruled to implement a 'preliminary injunction' until the final decision is made in the case filed on the grounds of 'absolute nullity' (legal invalidity) in the congress.
KILIÇDAROĞLU RETURNS
With this preliminary injunction decision, the term of office of Özgür Özel and the current party administration has ended. In line with the court decision, as the administration before the congress must be reinstated, the door has been opened for former Chairman Kemal Kılıçdaroğlu to temporarily return to the chairmanship.
The appeal process in the case will continue. In the process that may go up to the Court of Cassation, Kılıçdaroğlu will remain in office until the final decision is made.
