Following the 'absolute nullity' decision regarding CHP's 38th Ordinary Convention, the legal validity of the administrative structure formed after the convention and the decisions taken has become a matter of debate. In the newly shaped situation, it was stated that the expulsion decisions made during Özgür Özel's term have also become invalid. This development has paved the way for many individuals who had previously parted ways with the party to return to CHP's ranks. Among these names are Barış Yarkadaş, Gürsel Tekin, and Berhan Şimşek.
It was stated that with the absolute nullity decision issued by the Ankara 36th Regional Court of Appeal regarding the CHP and uploaded to the UYAP system, the CHP 38th Ordinary Convention held on November 4-5, 2023, and subsequent conventions were annulled, and Kemal Kılıçdaroğlu was reinstated as the Chairman.
EXPULSION DECISIONS ALSO INVALIDATED
The court decision noted that decisions made by party bodies serving during Özgür Özel's term were considered 'null and void'. In this context, it was stated that expulsion decisions taken in that period also lost their validity.
FORMER MEMBERS RETURN TO CHP
Following the decision, a new process began for those previously expelled from the party. The court ruling paved the way for the return of many individuals, including former CHP deputies Barış Yarkadaş, Gürsel Tekin, and Berhan Şimşek, to the CHP.
