In the second lawsuit opened regarding the death of Fatma Uraz (86) at a nursing home in Izmir's Güzelbahçe district, who was taken to hospital due to redness on her body after being given a bath and subsequently passed away, Doctor Naciye S. was sentenced to a judicial fine of 21,200 liras, to be paid in six equal installments, for the crime of 'causing death by negligence'.

A decision was made in the second lawsuit regarding the death of 86-year-old Fatma Uraz, who was staying in a private nursing home in the Güzelbahçe district of İzmir.

The incident occurred on September 16, 2018, in a private nursing home. Fatma Uraz, who was bathed by Nesrin Ö. and Tuğçe A., developed redness on her body, and some parts of her skin peeled off. The staff applied ointment to Uraz. Later, her relatives noticed the redness and took her to the hospital. Uraz died on September 21, 2018. Uraz's daughter, Zehra Yılmazer, filed a complaint against the staff. In the investigation launched, Nesrin Ö. and Tuğçe A., whose statements were taken, denied the allegations. In the indictment, while Tuğçe A. was found primarily at fault and Nesrin Ö. secondarily at fault, a lawsuit was filed against the two unarrested defendants with a demand for up to 6 years in prison for the crime of 'causing death by negligence.'

FIRST CASE FINALIZED

Defendant Nesrin Ö. was sentenced to 3 years in prison for the crime of 'causing death by negligence,' but the sentence was reduced to 2 years and 6 months due to her background, social relationships, behavior after the act and during the trial process. The other defendant, Tuğçe A., was sentenced to 4 years in prison for the crime of 'causing death by negligence.' A reduction was applied due to the defendant's background, social relationships, behavior after the act and during the trial process, and the effects of the given sentence on the defendant, reducing the sentence to 3 years and 4 months. Following objections to the sentences given to Nesrin Ö. and Tuğçe A., the case was taken to the appeals court. The 14th Criminal Chamber of the İzmir Regional Court of Justice upheld the local court's decisions, and the sentences given to the defendants became final.

ANOTHER LAWSUIT FILED

Following the objection of the family's lawyers, another lawsuit was filed against the nursing home's doctor, Naciye S. (58), in the İzmir 58th Criminal Court of First Instance for the crime of 'causing death by negligence.' While the defendant did not accept the charges against her, a verdict was reached at the 5th hearing. In the case heard at the İzmir 58th Criminal Court of First Instance, the prosecution, presenting its opinion on the merits, requested that the defendant be punished for the crime of 'causing death by negligence.' The defendant's lawyer stated that his client had no connection to the incident and requested an acquittal.

CONVERTED TO A FINE

After the defenses, the verdict was announced. The judge sentenced Naciye S. to 3 years and 6 months in prison for the crime of 'causing death by negligence,' but applied a reduction and converted her sentence to 2 years and 11 months in prison. Due to the defendant's personality, social and economic status, and behavior during the trial process, the prison sentence given to the defendant was converted to a judicial fine of 21,200 lira, corresponding to 1,060 days. Additionally, the defendant's economic situation was taken into account. Since it was understood that the defendant might face financial difficulty, it was ordered that the fine be paid in 6 equal installments.
