A citizen in Kayseri received a decision from the arbitration board and reclaimed the 97 TL commission fee charged for paying with a credit card during the inspection of his vehicle, amounting to 720 TL through enforcement.
Serdar Kayaaltı, who took his vehicle for inspection to TÜVTÜRK in Kayseri and paid a commission fee of 97 TL because he made the payment with a credit card, applied to the arbitration board to get back the commission fee he paid. Despite the arbitration board's decision to refund the 97 TL fee to the consumer, Kayaaltı, who could not get the money back, took TÜVTÜRK to court and placed a freeze on their bank accounts.
PAID 97 TL AND GOT BACK 720 TL
Describing the process he went through with TÜVTÜRK, Serdar Kayaaltı said, "My vehicle's inspection was due, and I had to take it to TÜVTÜRK for inspection. When I went for the inspection, they asked for the inspection fee, and I wanted to pay with a credit card. While making the payment with a credit card, they asked me for a fee of 97 TL under the name of a commission fee. I objected to this, but since the employees could not come up with a solution, I had to pay it because I had to get the inspection done. After having my inspection done, I applied to the arbitration board. When I applied to the arbitration board, I received a decision for the refund of the 97 TL collected from me, including VAT. I obtained a legal decision from the arbitration board and enforced this legal decision. Despite enforcing it, they still did not pay, so I went and placed a freeze on their accounts at a bank, collecting approximately 720 TL from TÜVTÜRK," he said.
"CONSUMERS HAVE RIGHTS TOO"
Mahmut Şahin, the President of the Consumers Union, stated that just as there are seller rights, there are also consumer rights, noting that "In our country, it is thought that consumers have no rights. But they do; the law grants the rights given to sellers to consumers as well. Consumers have a body like the 'arbitration board.' They can apply to this body and claim their rights. They constantly threaten consumers with statements like 'we will cut off the service, we will charge interest, we will take legal action.' It never occurs to us that the consumer can do the same.
