"I HAVE 9 YEARS IN PRISON, IF YOU DON'T SHOOT ME, YOU ARE NOT A MAN"

In the hearing held at the Boyabat Criminal Court of First Instance regarding the incident, guard Eren Y. stated, "On the day of the incident, we noticed 2 people calling out to a shopkeeper during a curfew. We told them in a suitable manner that there was a curfew and they needed to go home. Görkem Sertaç responded to us with 'who are you?' Later, his father Alpay Göçmen came to us and said that his son was drunk and had a confirmed 9-year sentence, and that his son was in a bad mood. We told them to go home with understanding. As they moved a little away from us, Görkem Sertaç said, 'they are making dogs and bastards into guards.' My friend Osman reported to the police. Görkem Sertaç approached me and made a move towards my gun. He said to me, 'I have 9 years in prison, if you don't shoot me, you are not a man. Am I supposed to be afraid of you?'

"MY SON IS HAVING A NERVOUS BREAKDOWN, IF HE SEES YOU, HE WILL GET EVEN MORE ANGRY"

Police officer Bekir M. stated, "There was a resistance incident with the neighborhood guards. I listened to the guards about the incident. I called the defendant's father Alpay Göçmen and invited him to the police station. He said he would come, but that his son was having a nervous breakdown. I reported the situation to the on-duty public prosecutor. I received instructions to capture the person and carry out the necessary procedures. Meanwhile, we received a report that the 112 ambulance requested a reinforcement police team. I set out with 2 police friends. On the way, we saw the defendant's father Alpay Göçmen. He stopped us and said, 'my son is having a nervous breakdown, if he sees you, he will get even more angry.' We invited him to the vehicle, and he got in. At that moment, Görkem Sertaç came from the opposite side with a gun in his hand. We couldn't tell that the gun was a blank gun; it was nighttime. The defendant's father said that the gun was a blank gun and that he would talk to his son. The person was then taken to the hospital by ambulance," he said.

"I DO NOT CONSENT TO WORK IN A PUBLICLY BENEFICIAL JOB"

The defendant Görkem Sertaç Göçmen, stating that he was attacked by a dog before the incident, said, "On the day of the incident, I was in a bad mood and had been drinking alcohol. I went out with my father to buy cigarettes; I didn't think about the ban. To protect myself from dogs, we took a blank gun and a bead gun with us. When I saw that the shop where I was going to buy cigarettes was closed, I called out because I knew the owner was upstairs. When he didn't hear me, I started shaking the shop's shutter. At that moment, 2 night guards came to us. They started acting as if they were catching a thief. They saw the bead gun I was carrying. They started looking at me as if I had committed a crime. I was disturbed by this. They indicated that there was a curfew. They approached me. My father held my arm to calm the situation. While we were heading home, I said, 'when a dog attacks, no one comes to help, but now the night guards are on duty.' From behind, I heard a voice saying, 'come on son, what are you talking about?' I got angry because my father was called son. I said to the guards, 'how do you talk to me?' The guard replied, 'am I going to learn what to say from you?' I definitely did not say they are making dogs and bastards into guards. When I got home, I punched the bathroom window. I got injured on my right arm, so my father called an ambulance. When the ambulance arrived, we went downstairs together with my father. I had a blank gun and a bead gun in my coat pocket. I forgot about these guns because of the incident I experienced. My father was going to go to the police station to give a statement about the incident we had with the guards. When I realized I had a gun on me and that I couldn't go to the hospital with a gun, I followed him to give it to my father. I handed over the guns I was carrying to my father. I did not point the gun at the police. If I am punished, I do not consent to work in a publicly beneficial job," he defended himself. The court announced its decision regarding the incident, sentencing Görkem Sertaç Göçmen to 2 years and 6 months in prison for the crime of 'threatening multiple people with a weapon.' The defendant Göçmen was also sentenced to a judicial fine of 10,620 TL for the crime of 'publicly insulting a public official.' No postponement or suspension of the announcement of the verdict was applied in the penalties given. Additionally, the Boyabat Criminal Court of First Instance sent a notification to the Bakırköy Criminal Court of First Instance regarding the postponement of the announcement of the verdict. In the document, it was stated that the defendant Göçmen had committed a deliberate crime again during the probation period, and therefore the decision of the Bakırköy Criminal Court of First Instance regarding the postponement of the announcement of the verdict should be announced.```html

COMMITTED A CRIME OF THREAT WITH A WEAPON

In the indictment announced by the Boyabat Chief Public Prosecutor's Office, it was recorded that on November 28, 2020, the defendant Görkem Sertaç Göçmen insulted two officials who were neighborhood watchmen by saying, 'they are making a dog the watchman.' The indictment stated that after the incident, the defendant Göçmen injured his arm and that police officers were called to the scene due to the problems he caused for the health personnel who arrived at his home. It was revealed in the indictment that Görkem Sertaç Göçmen pointed a blank-firing gun and a pellet gun at a vehicle with three police officers. The indictment noted that the defendant committed the crime of insult in the first incident and the crime of threat with a weapon in the second incident.
