The second hearing of the case regarding the brutal attack on the Baca family, who had four children and had a dispute with their neighbors over 'noise' about a year ago after moving into a house in the Esenköy district of Çınarcık, Yalova, was held. The detained suspect Şener Ergin attended the trial, held at Yalova 2nd Criminal Court of First Instance, via SEGBIS. The attorneys of the parties and gendarmerie personnel were also present in the courtroom.

GENDARMERIE TESTIMONY: WE DID NOT SEE THE MOMENT OF THE HIT

At the hearing, gendarmerie personnel who went to the area upon a report on the day of the incident were heard as witnesses. Witness gendarmerie K.K. stated that when they arrived at the scene, an argument broke out between the parties and women started pushing each other, saying, 'I heard Muhammet Baca say 'It hit the child,' but I did not see the moment of the hit.'

Another witness, gendarmerie M.Ç., stating that his back was turned at the time of the incident, said the following:

'I heard a 'crack' sound. When I turned around, I saw suspect Şener Ergin holding a piece of plastic scooter. Upon seeing that, I approached Şener and moved him away. Since my back was turned to Baca, I did not see the moment of the hit.'

M.Ç. stated that it was mentioned the camera clearly viewing the front of the building was not working, while the family's attorney argued that it was contrary to the normal course of life that three gendarmerie personnel on duty also did not see the moment of the hit, and that evidence was being tampered with. The attorney stated that the suspect should be tried at the Heavy Penal Court for the crime of 'Attempted intentional murder' and requested a decision of lack of jurisdiction.

Although the prosecutor's office requested the continuation of detention, the court panel rejected the request to transfer the case to the Heavy Penal Court. The court decided to examine the cameras viewing the front of the building and released suspect Şener Ergin with a travel ban abroad and a requirement to sign twice a week.

Father Muhammet Baca, who left the courtroom after the court's refusal to send the file to the Heavy Penal Court and rebelled against the decision, made statements to journalists at the courthouse exit together with his wife and the battered baby girl İkra:

'I am the father of baby İkra. My daughter, when she was 14 months old, was brutally beaten there, with three fractures on her head, and suffered a brain hemorrhage. As a father, I am still fighting for this. I have just left the courtroom, I will go to Ankara, to the Ministry of Justice. I will seek my daughter's rights.

Two days ago, I was followed by motorcyclists, I am being threatened. For four months, my children's psychology has been ruined, our household order is gone. They forced me to sell my house, I left that place. I am a victim and I will seek my rights to the end before the law. No one can bring this girl to this state, everyone will be held accountable.'
