It has emerged that Alihan Kuris, the leader of the organization publicly known as 'Suleymancis' and the 'Alihan Kuris Criminal Organization,' attempted to unlawfully seize the Arden Gida company, which he inherited from his uncle, former Minister of Transport Arif Ahmet Denizolgun, who passed away in 2016, in violation of inheritance law. Kuris's inheritance scheme, which sought to remove Mehmet Beyazit Denizolgun, one of Arif Ahmet Denizolgun's two legal heirs, from the Arden Gida company, was overturned in court.

In the scope of the "Alihan Kuriş Criminal Organization" investigation conducted by the Ankara Chief Public Prosecutor's Office, it has been revealed that Alihan Kuriş, who is under arrest, attempted to seize the Arden Gıda company, in which his uncle Arif Ahmet Denizolgun, the former Minister of Transport and previous leader of the Süleymancılar community, held a 90 percent share, in violation of inheritance and probate law.

ALL ASSETS LEFT TO HIS TWO LEGAL HEIRS, HIS SIBLINGS

Arif Ahmet Denizolgun, who led the Süleymancılar community between 2000 and 2016, passed away on September 7, 2016. Since Denizolgun was unmarried, all his assets were left to his two legal heirs: his brother Mehmet Beyazıt Denizolgun and his sister Ayşe Gülderen Kuriş.

ATTEMPT TO SEIZE ARDEN GIDA WITH FORGED DOCUMENTS

One of the companies owned by Arif Ahmet Denizolgun was Arden Gıda. Founded in 2004 with a capital of 7 million 450 thousand liras, 90 percent of Arden Gıda's shares belonged to Arif Ahmet Denizolgun, 5 percent to Alihan Kuriş, and 5 percent to Hilmi Tuna Kuriş. Due to Arif Ahmet Denizolgun's death, his 90 percent share in Arden Gıda should have been transferred to his legal heirs, Mehmet Beyazıt Denizolgun and Ayşe Gülderen Kuriş.

However, during a general assembly meeting held at Arden Gıda headquarters on December 1, 2016, Alihan Kuriş and his brother Hilmi Tuna Kuriş decided to transfer 45 percent of Arden Gıda's shares to their mother, Ayşe Gülderen Kuriş, and to purchase the other 45 percent share, which should have been transferred to Mehmet Beyazıt Denizolgun, from him for 500 thousand liras, dividing it equally between Alihan Kuriş and Hilmi Tuna Kuriş.

LOWER COURT REJECTED THE CASE, DECISION OVERTURNED ON APPEAL

Mehmet Beyazıt Denizolgun, the legal heir thus eliminated from Arden Gıda, brought the matter to the judiciary. After a trial lasting approximately 2 years, in 2018, the Istanbul Anatolian Commercial Court of First Instance ruled for the dismissal of the case, stating that the plaintiff, Mehmet Beyazıt Denizolgun, had applied to the judiciary without objecting to the company's general assembly meeting dated December 1, 2016. Following this, Mehmet Beyazıt Denizolgun appealed the decision to a higher court.

The 13th Civil Chamber of the Istanbul Regional Court of Appeals re-examined the file and overturned the decision of the court of first instance on October 8, 2020. It deemed the meeting held by Alihan Kuriş and Hilmi Tuna Kuriş on December 1, 2016, at Arden Gıda headquarters invalid and ruled that 45 percent of Arden Gıda's shares be transferred to Mehmet Beyazıt Denizolgun as the legal heir.

LEFT ARDEN GIDA AFTER THE DECISION

Following the transfer of 45 percent of Arden Gıda's shares to Mehmet Beyazıt Denizolgun by court decision, Alihan Kuriş left Arden Gıda officially on July 13, 2021, by transferring his 5 percent share in Arden Gıda to his brother Hilmi Tuna Kuriş and Adem Yüksel.

On December 28, 2022, Ayşe Gülderen Kuriş and Hilmi Tuna Kuriş also left Arden Gıda by transferring their shares in the company to Yusuf Bulut.

TRUSTEE APPOINTED AFTER THE OPERATION

Today, a trustee was also appointed to Arden Gıda company, whose shares appear to be 53 percent owned by Yusuf Bulut, 45 percent by Mehmet Beyazıt Denizolgun, and 2 percent by Adem Yüksel, following the operation conducted against Alihan Kuriş.
