The trial of 22 defendants, including former CHP Istanbul Provincial Chair Canan Kaftancıoğlu, regarding the alleged 'money counting' footage recorded at the CHP Istanbul Provincial Headquarters continued. During the hearing, the non-detained defendant Kaftancıoğlu stated, "My monthly income is around 100,000 lira. I have a case that has been assigned by the Heavy Penal Court." Meanwhile, the case has been postponed to November 19.
In the case regarding the 'money counting' footage at the Republican People's Party (CHP), the trial of 22 defendants, including former CHP Istanbul Provincial Chair Canan Kaftancıoğlu, Istanbul Metropolitan Municipality Sports Club President Fatih Keleş, and General Manager of İmamoğlu Construction Company Tuncay Yılmaz, continued.
KAFTANCIOĞLU: MY MONTHLY INCOME IS 100 THOUSAND LIRA
The hearing, held at the Istanbul 59th Criminal Court of First Instance, took place in the larger courtroom of the 37th Heavy Penal Court. Other defendants, including the former CHP Istanbul Provincial Chair Canan Kaftancıoğlu, who is not in custody, attended the hearing along with other non-custodial defendants Can Poyraz, Özgür Nas, and Hüseyin Kalkan. İBB Sports Club President Fatih Keleş and General Manager of İmamoğlu Construction Company Tuncay Yılmaz participated via the Audio and Visual Information System (SEGBİS). The courtroom was filled with lawyers and numerous spectators. During the identification process, Canan Kaftancıoğlu stated, "My monthly income is around 100 thousand lira. I have a file from the Heavy Penal Court; I have a criminal record."
"I RECEIVED A SUM OF MONEY TO DELIVER TO THE SELLER"
Defendant Fatih Keleş, who is in custody for another crime, stated, "At that time, I was serving as a CHP Beylikdüzü Municipal Council member and President of İBB Sports Club. Turan Taşkın Özer was not a member of parliament at that time; he was serving as the district chair of the party in Beylikdüzü. He called me and said they were campaigning regarding the purchase and sale of the CHP provincial building, and he asked me to take a sum of money collected during the campaign to the lawyer's office to be delivered to the seller. I received the money from him. I delivered it to the Deputy Provincial Chair Özgür Nas at the lawyer's office as he instructed. I did not have any actions of receiving or giving donations; I do not accept the accusation. I request my acquittal. Additionally, I request time to prepare a defense on the merits," he said.
"I REQUEST MY ACQUITTAL"
Defendant Tuncay Yılmaz, General Manager of İmamoğlu Construction Company, who is in custody for another crime, participated in the hearing via SEGBİS. Yılmaz stated, "At that time, I was serving as the general manager of İmamoğlu Construction. On the date of the incident, Fatih Keleş asked me to take a bag full of money to the lawyer's office. I took this money to the lawyer's office to help. I did not have any actions of receiving or giving donations during this process. I am innocent; I request my acquittal," he said.
"WE LAUNCHED A CAMPAIGN CALLED 'PUT A BRICK TOO'
Former CHP Istanbul Provincial Chair Canan Kaftancıoğlu, one of the non-custodial defendants, stated, "At that time, I was serving as the Provincial Chair of the CHP. I became the provincial chair in 2018, and when I took office, there was a need for a provincial building. We gathered with friends regarding this matter. We started working to purchase a provincial building. We launched a campaign called 'Put a Brick Too' across Turkey. During the continuation of the campaign, we found a building that could serve as a provincial building and liked it. We negotiated with the owner of the building and reached an agreement. The only issue we could not agree on was the owner's request to show a lower sale price in the title deed records, even though we purchased the property for 41 million. Later, we accepted the owner's request, and the purchase and sale took place. Receipts were issued while donations were being collected and given regarding this. The Political Parties Law specifies a limit for donations. Those who want to donate above this limit, due to legal restrictions, donate as much as the law allows and show their relatives, friends, and acquaintances as donors for the excess. All parties do this. I do not accept the accusations against me; I request my acquittal. Moreover, the video recordings submitted to the file are considered illegal evidence and should not be evaluated as evidence. Additionally, the supervision of political parties is conducted by the Constitutional Court," she said.
"I GAVE 50 THOUSAND LIRA IN CASH WITHOUT RECEIVING A RECEIPT"
Non-custodial defendant Hüseyin Kalkan stated, "I own a business selling meat in the Maltepe district, and I am not a member of any party. I have a close friendship with the Maltepe District Mayor. At that time, Ali Kılıç told me that they were launching a campaign called 'Put a Brick Too' and asked me to make a donation. Trusting our friendship, I asked for someone from the CHP district organization to be sent, and I expressed my desire to make a donation. Someone from the district organization came, and I donated 50 thousand lira; I gave the donation in cash, but I did not receive a receipt in return. I did not know that a receipt was necessary. I have also made donations to different NGOs, and I have received receipts for some and not for others. I did not know this would constitute a crime; I request my acquittal," he said.
POSTPONED TO NOVEMBER 19
The court decided to postpone the hearing to November 19, Wednesday, at 10:00 AM to address the missing issues and to hear witness Şevval Adalı.
FROM THE INDICTMENT
In the indictment prepared by the Istanbul Chief Public Prosecutor's Office, it was stated that donations were made in violation of the procedure specified in the law for the 'Put a Brick Too' donation campaign initiated by the CHP in 2019, and that donations were collected or accepted in violation of the law and delivered or ensured to be delivered to the seller. The indictment also mentioned that 14 properties located in Sarıyer Ayazağa Neighborhood C Block were sold to the CHP by SEAS Livestock Company official Ali Rıza Braka on December 11, 2019, and that the money in the footage belonged to this sale. It was recorded that 14 independent sections were registered in the name of the CHP for 24 million 369 thousand lira.
REQUEST FOR 6 MONTHS TO 1 YEAR IN PRISON
The indictment stated that the amount of money used during the purchase of the party building, which was counted in cash and delivered in hand, was 15 million 510 thousand lira, and that according to the report of the Sarıyer Land Registry Office, a 'Real Estate Sale Promise Agreement' was drawn up between Ali Rıza Braka and Canan Kaftancıoğlu on behalf of the CHP at the Beyoğlu 3rd Notary on November 6, 2019, in which the total purchase price of 14 independent sections was shown as 24 million 360 thousand lira, and that after the agreement, the 14 independent sections were registered in the name of the CHP for 24 million 369 thousand lira on December 11, 2019.
The indictment also stated that 22 suspects, including former CHP Istanbul Provincial Chair Canan Kaftancıoğlu, İBB Sports Club President Fatih Keleş, General Manager of İmamoğlu Construction Company Tuncay Yılmaz, former Şişli Mayor Muammer Keskin, and former Maltepe Mayor Ali Kılıç, were charged with 'Illegal donations, loans, or debts, and receiving or giving loans' in violation of the Political Parties Law, with a request for imprisonment of 6 months to 1 year.
