A 34-year-old woman identified as T.S., who married in Istanbul in 2019, and her 39-year-old husband G.S. filed a mutual contested divorce case in 2023 on the grounds that the marital union had been fundamentally shaken. In the hearing held last month, the court found T.S., who was determined to have met and corresponded with her ex-spouse, fully at fault. The court ordered T.S. to pay 100,000 TL in material and 100,000 TL in moral damages to G.S., and rejected T.S.'s alimony request.
LETTERS TO EX-SPOUSE IN PRISON ENTERED THE CASE FILE
Store manager G.S. and sales representative T.S., who has one daughter from a previous marriage, married in Istanbul in 2019. The couple filed a mutual contested divorce case in 2023 on the grounds that the marital union had been fundamentally shaken.
T.S., claiming she suffered psychological devastation in her married life, demanded 500,000 TL in material and 500,000 TL in moral damages, along with 5,500 TL in alimony.
G.S., stating that T.S. had video calls and corresponded with her ex-spouse, who was in prison during the marriage, demanded 200,000 TL in material and 200,000 TL in moral damages.
"I FOUND THEIR CONVERSATIONS SINCERE"
The 8th Family Court of Kucukcekmece, in the hearing held last month, found T.S., who was determined to have met and corresponded with her ex-spouse, fully at fault.
Witness P.Y., heard in court, said, "Both parties are my friends. After they got married, T.S. used to say she wouldn't do much cleaning or cooking at home. Actually, G.S. did the cooking at home. Since we visited each other very often, we tidied up their house many times. Whenever we went to their home, it was messy. She didn't clean the house. Before T.S. left the house, her ex-spouse was about to be released. Apparently, she was granted video call rights with her ex-spouse close to his release. There were times when I was with them, and T.S. was having video calls with her ex-spouse. I found their conversations somewhat sincere. I had warned T.S. as well. After all, she was married to someone else, and the person on the other end was her ex-spouse. She told me that he was her daughter's father and that's why they were talking, but they weren't really having conversations on behalf of her daughter."
LETTERS LED TO HER DOWNFALL
The court ordered T.S. to pay 100,000 TL in material and 100,000 TL in moral damages to G.S., lifted T.S.'s interim alimony, and also rejected her alimony request.
