Watch Skins Corporation, which works on blockchain technology, has filed a significant patent infringement lawsuit against luxury fashion giant LVMH. The company claims that its patented technology for displaying NFTs in smartwatches has been used without permission in TAG Heuer watches.
NFT Technology Used in TAG Heuer Watches Causes Legal Issues
A blockchain company developing NFT technology has filed a patent infringement lawsuit against luxury fashion giant LVMH. On March 10, Watch Skins Corporation filed in a federal court in Texas, alleging that LVMH has unlawfully used its "pioneering NFT display technology."
Watch Skins stated that it has developed a unique system that allows verified NFT artworks to be displayed on smartwatches and holds multiple patents for this technology. The company claims that the NFT display technology based on three patents owned by Watch Skins has been illegally used in TAG Heuer's smartwatches and products of other brands under the LVMH umbrella.
LVMH is known as a multinational holding company that owns dozens of well-known luxury brands, including Louis Vuitton, Givenchy, TAG Heuer, Tiffany, Christian Dior, Hennessy, and Moët & Chandon champagne brand.
Watch Skins detailed the scope of its patents. The first patent covers a system that verifies NFT ownership before it is displayed on a watch face. The second patent includes a system that requires verification through a blockchain wallet before an NFT is displayed on a smartwatch. The third patent focuses on acquiring and displaying customized watch faces based on NFT ownership.
The lawsuit alleges that TAG Heuer has encouraged its customers to infringe the patent by providing instructions on how to use the NFT viewing features. The complaint states, "The watch allows the display of the NFT if it belongs to the user's crypto wallet and connects to the user's crypto wallet to guarantee the authenticity of the displayed artworks."
While requesting a trial before a jury, Watch Skins seeks compensation for lost profits and royalties due to the infringement. The company also requested a court order to prevent LVMH from further using the patented technology.
Watch Skins announced in 2020 that it launched the world's first Blockchain NFT watch face marketplace at the Consumer Electronics Show in Las Vegas. In a statement at that time, the company noted that the mobile application they developed offered consumers the opportunity to purchase "authentic, licensed smartwatch faces from their favorite brands."
