The body of Rojin Kabaiş, who was found 18 days after going missing in Van, was found to contain DNA from two different men. According to the additional report prepared, Rojin died on the day she went missing and had been in the water from that day until the date she was found.

The additional report requested regarding university student Rojin Kabaiş (21), whose lifeless body was found in Van, has emerged concerning the duration of submersion and time of death. The report states that Rojin died on the day she went missing and that it was unanimously concluded that she remained in the water from that day until the date she was found.

Rojin Kabaiş, a first-year student in the Child Development Department of Van Yüzüncü Yıl University (YYÜ), went missing after leaving the dormitory on September 27 and was not heard from again. Her lifeless body was discovered on October 15 by Mehmet Emin Ankay (60) in the rural Mollakasım neighborhood. According to the autopsy results, the cause of death was determined to be drowning. While the investigation into Rojin's death continues, her father Nizamettin Kabaiş stated in his remarks that he does not believe his daughter committed suicide. Additionally, Nizamettin Kabaiş collected his daughter's belongings from the dormitory and brought them home, filming the items spread out in the living room, asserting that Rojin would not harm herself.

"IF MALE DNA IS OBTAINED, COMPARISON CAN BE MADE"

Upon the request of the Van Chief Public Prosecutor's Office for an additional report regarding Rojin Kabaiş's duration of submersion and time of death, the 1st Forensic Medicine Specialization Board prepared a report. The report referenced previous forensic and medical documents, stating, "In the examinations of 5 nail samples and 79 swab samples reported to have been taken from the deceased;

  • 46 swab samples did not yield DNA results.
  • No comparable DNA profile was obtained from 10 swab samples.
  • A compatible female DNA profile matching the deceased's DNA was identified in 5 nail samples and 21 swab samples.
  • Different male DNA profiles were obtained from 2 swab samples alongside the deceased's DNA. Preliminary examination of these different DNA profiles did not reveal any suspicious findings in the samples.

Therefore, it was considered necessary to eliminate the possibility of contamination, and in this context;

  • Our institution has screened the work steps regarding contamination risk from the time the deceased was transferred to the autopsy site. DNA comparisons were conducted, and the contamination risk from the Forensic Medicine Institution has been eliminated.
  • The contamination risk that may have occurred during the transfer of the deceased from the location where she was found to the autopsy site could not be eliminated due to the lack of biological samples and records belonging to the relevant individuals.
  • After eliminating the contamination possibility mentioned in paragraph b, there remains a possibility that the different DNA profiles obtained may belong to suspects. In this regard, if biological samples belonging to the suspect or suspects are sent, comparisons can be made," it was stated.

"MEDICAL EVALUATION CANNOT BE MADE"

The conclusion section of the report included the following statements;

"It is deemed appropriate to obtain an opinion from the Forensic Medicine Institution's 1st Specialization Board by sending the autopsy report, photographs related to the autopsy, all past medical records, the crime scene investigation report, and all statements included in the entire judicial investigation file regarding the cause of death and other inquiries," it was recorded.

RESULT: Considering the judicial and medical documents prepared regarding Rojin Kabaiş, born on 20/03/2003, who was reported to have been found dead on the shore in Mollakasım village, Tuşba district of Van province on 15/10/2024;

1. Although a detailed traumatic change analysis could not be performed due to decomposition in the external examination of the autopsy, it was noted that the integrity of the skin was preserved, and no injuries that could penetrate the head, chest, and abdominal cavity were detected. In the internal examination, no fractures in the skull, intracranial bleeding, brain tissue destruction, brain hemorrhage, or lesions in internal organs and major vessels were found;

With the existing data, there is no medical evidence that the person died from a traumatic effect,

2. The alcohol level detected in the tissue samples taken during the autopsy was not at a level that could cause death on its own, and it was determined to be due to decomposition. The Ornidazole detected is an active ingredient used in infection treatment, and the Rokuronium detected is an anesthetic substance given to the person during surgery on 11/09/2024, which is known to be detectable in the body for 2 (two) months. Considering that no toxic substances were found; there is no medical evidence that the person died from poisoning,

3. Considering the findings obtained, there is no medical evidence of violation of sexual inviolability,

4. In the information recorded in the judicial file; the person was reported missing on 27/09/2024 and found dead on the shore of Lake Van on 15/10/2024, with no traumatic changes or toxic substances that could have caused death. Considering the macroscopic findings in the internal organs and the findings obtained from the histopathological examination of the internal organs, the environment in which the body was found, the manner of discovery, and the crime scene investigation findings; it is necessary to accept that the person's death occurred as a result of drowning, but it could not be medically evaluated whether the drowning was a suicide, accidental, or caused by another person or persons, and these matters should be clarified through judicial investigation," it was recorded.

The conclusion section of the report also stated, "Considering the judicial and medical documents prepared regarding Rojin Kabaiş and the data in the autopsy report; taking into account the information recorded in the judicial file, the environment where the body was found, the manner of discovery, the findings from the crime scene investigation, the findings identified in the autopsy, and the findings obtained from the examination of the crime scene and autopsy photographs conducted by our institution; it is unanimously concluded that the person's death may have occurred on the date she went missing, 27.09.2024, and that she may have remained in the water during this period."
