The Istanbul 2nd Civil Court has decided to terminate the duties of Istanbul Bar Association President İbrahim Kaboğlu and the board members. Lawyers who wanted to protest the decision by walking from the Istanbul Courthouse in Çağlayan to Taksim were intervened by the police.
The Istanbul Chief Public Prosecutor's Office filed a lawsuit requesting the "dismissal of Istanbul Bar Association President İbrahim Kaboğlu and the members of the board of directors." The Istanbul 2nd Civil Court of First Instance announced its decision in the hearing held today.
WITNESS HEARINGS, REQUESTS FOR OPINIONS FROM TBB, AND REQUESTS FOR RECUSAL WERE REJECTED
The court rejected the claims of unconstitutionality, requests for witness hearings, and requests for opinions from the Turkish Bar Association (TBB). The court also did not accept the recusal request on the grounds that 'no convincing evidence and indications were presented.'
THE DUTIES OF THE ISTANBUL BAR ASSOCIATION BOARD MEMBERS HAVE BEEN TERMINATED
The court that accepted the indictment terminated the duties of the members of the Istanbul Bar Association Board of Directors in accordance with the 5th paragraph of Article 77 of the Attorneyship Law. The court decided that new members should be elected within a maximum of 1 month according to the procedures and principles in the Attorneyship Law, following the finalization of the decision.
THE DECISION CAN BE APPEALED TO THE COURT OF APPEALS
The court's decision can be appealed to the Court of Appeals within a two-week legal period from the notification of the reasoned decision. The 5th paragraph of Article 77 of the Attorneyship Law, referred to by the court, regulates that the management of bar associations operating outside their intended purposes can be dismissed.
POLICE INTERVENTION AGAINST LAWYERS PROTESTING THE DECISION
Lawyers who are members of the Istanbul Bar Association reacted to the decision. Police intervened against the lawyers who wanted to march from the Istanbul Courthouse in Çağlayan to the Istanbul Bar Association building in Taksim to protest the decision. During the intervention, a scuffle occurred between the lawyers and the police.
